To the honorable James W.F. Allen, Judge of the Circuit Court for the County of Rockingham.

The Bill of Complaint of Rosalonia Ann Shifflett by Eli Keeran, her best friend, both of Rockingham Co., respectfully sheweth that about 22 years ago she married Moton Shiflett and that for the last 10 years they have been living in the County of Rockingham. That they lived together very unhappily in consequence of her husband's abuse and his frequent assaults upon her person not with standing complainant bore with it until about 6 months ago he took another woman into the house to live with him and would go to bed with her right before complainant's face. Complainant bore with this for about 3 months, when she left home. (During these 3 months complainant and her husband did not occupy the same bed.) She did not take steps immediately to procure a divorce in the hope that he would abandon his habits and reform, but it was a vain hope. He continued to live in adultery with said woman up to the present time and by her has 2 children. Complainant charged her husband is now and has been for about 6 years living in adultery with said woman and that complainant has not cohabited with him, said husband, since her knowledge of said adultery. Complainant has two living children by said husband; the oldest near 21 years of age and a boy, the youngest, a son of 6 years and upwards old. Complainant has had the care of these children ever since she discovered the adultery on the part of her said husband and she desires to retain custody of the younger. Her husband is poor and she asks nothing in the way of alimony. In tender consideration of the premises and for as much as complainant is without relief save in a court of equity, she prays a divorce from the bonds of matrimony may be decreed her and that he the said Moton Shiflett may be made a party defendant to this bill for and for such other and further relief as is suited to her cause.

Deposition taken pursuant to notice before J.R. Jones Comm. in Chancery at his office in Harrisonburg on Thursday the 17th day of December 1885 to be heard as evidence in behalf of the Plff. in the above entitled cause. Present Plff. in person & her counsel W.L. Yancey


Elizabeth A. Shiflett a witness in her own behalf being duly sworn deposed & says.
Quest. by Plffs. Counsel - State your age & residence
Ans. - 48 years of age, reside in Rockingham County.
2 by same - State when you were married to Asa Shiflett?
Ans. - Six or seven years ago in May.
3 by same - State whether of not, since your marriage with him, he has been a dutiful and kind husband, and has made any provision or support for you since your marriage?
Ans. - No sir, he has not tried to do it.
4 by same - State whether or not he has been cruel to you, and if so what acts of cruelty?
Ans. - He has beat me, and destroyed something I had on the place, and often threatened to kill me, and twice raised an axe over me.
5 by same - State whether or not you had a marriage contract with him before your marriage; and whether or not he had the right to exercise any control over your property, either real or personal?
Ans. - I had a marriage contract with him, which I here file. He had no right to control any of my property.
6 by same - State whether or not he spent much of his time at your house, or whether he spent most of his time running around at other places.
Ans. - He spent as much time running around as he did at my house. When he did come it was to get something to eat.
7 by same - State whether or not from the way he conducts himself at your house you are afraid to live with him.
Ans. - I am.

Ans. - 64 years of age, reside in Rockingham, am a farmer.
2 by same - State whether or not you are acquainted with Asa Shiflett and his wife Elizabeth A. Shiflett, if so, what do you know of his married life, has it been pleasant or unpleasant.
Ans. - I am acquainted with them, live near them. Their married life has been very unpleasant.
3 by same - State whether or not he has been cruel to her or has made any support for her?
Ans. - Yes sir he has been cruel to her. She came to my house one rainy night about midnight, and told me that her husband had ran her away from home, and wanted me to go with her to Squire Maiden's. I went with her. He has made no support for her that I know.
4 by same - Does he spend much of his time at her house, or did he spend it running around?
Ans. - Most of his time running around.
5 by same - State from your knowledge of Asa Shiflett, whether or not it would be safe for Mrs. Shiflett to live with him, or whether to do so would endanger her life?
Ans. - I do not think her life would be safe with him, for he has been making some threats.
6 by same - What threats has he made?
Ans. - He said that he was going to cut her throat.
And further he says not.

Ans. - I am going on 22 years of age, I live near Goods Mill, Rockingham County.
2 by same - State whether or not you ever saw Asa Shiflett with any other woman besides his wife, Elizabeth A. Shiflett.
Ans. - Yes sir I did.
3 by same - State when and where and with whom he was with?
Ans. - They call her Ad Grimm, but Ad Bailey is her right name. It was about a year ago as near as I can tell. It was near Port Republic at a place they call New Haven. He was with her there.
4 by same - State whether or not you saw any dirt on this woman's back?
Ans. - Yes there was when she came into the house.
5 by same - State whether or not you saw them go out of the house into the yard, and if so what did they do?
Ans. - I did not see them go out, but saw them after they got into the yard, she laid down and he got on top of her, and I suppose did it to her. Her dress was up, the signs and movements were all right. This was after night.
And further he says not.

Ans. - 40 years of age, reside in Rockingham, am a farmer.
2 by same - State whether or not you know Eliz. A. Shiflett and Asa Shiflett, and what you know of their married life, whether it has been happy or unhappy?
Ans. - I know them, their married life has been very unhappy.
3 by same - Why has it been unhappy. Has he been cruel to her or made any provision for her?
Ans. - For several reasons. I have heard him say that he would cut her inside out, and he would not do anything for her support, nor let anyone haul her wood or do anything for her. He seemed to be trying to starve her out and make her suffer all he could. I have seen running to old Polly Grimm's who had a daughter of bad character . It was no place for a married man to go to, From what I could learn he would stay there several days at a time.
4 by same - From what you know of Asa Shiflett would it be safe for her to live with him, or would it be better to have the marriage relation dissolved?
Ans. - They had better be apart.

Ans. - No sir, his conduct has been unkind and he has not provided for her.
3 by same - State whether of nor you ever saw him commit any act of violence against your mother?
Ans. - I have seen him draw the axe over her and threaten t kill her.
3 by same - State whether or not you think it safe for your mother to live with him, and would her life be endangered?
Ans. - No sir, I do not think her life would be safe with him.
4 by same - State whether or not you know anything of his visiting other women?
Ans. - Yes sir, he visits other women.
