Transitory things of this world and being desirous to settle things
In order to make and ordain this my last will and testament

September Seventh one thousand seven hundred and ninety four. I John Shiflett of the County of Albemarle and state of Virginia being weak of Body but of perfect mind and memory, thanks be to God for the same but calling to mind the uncertainty of life, who Knowing that it is appointed once for all men to die make and ordain this my last will and testament that is to say as follows I give and recommend by soul to all mighty God my body to the Earth to be buried in a decent form douting But I shall recover the same at the General Reserrection - And touching such Estate wherewith it has been pleased God to bless me in this I hereby give demise and dispose of the same in the following manner Item I give and bequeth to my wife Joice all my lands tenaments and perishable Estates of all kinds during the time she remain my widow and at the decease of my said wife Joice I give to my daughter Mary the tract of land wherein I now live and the negro woman named Jane and her issue also at the Death of the said Joice Shiflett, my wife I leave my son Joel the sum of thirty pounds to be raised and paid out of my estate, and the remaining part of my estate at the same time to be equally divided among all my children and I further appoint and request Charles Goodman and Roland Horseley to execute this my last will and testament.

In the name of God amen the thirteenth april in the year our Lord one thousand seven hundred and ninety seven I George Booth freeholder of the County of Albemarle being very sick and weak in body but of perfect mind and memory thanks be to god for the same and calling to mind the mortality of my body and Knowing thats appointed all men once to die doth make and ordain this my last will and testament that is to say principally and first of all I give and recommend my soul to God that I give all for my body I recommend to the earth to be buried in a decent manner at the direction of my executors nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God. and touching such worldly estate I give devise and dispose of the same in the manner and form following that is to say I give and bequeath to Elizabeth Booth my wife all my household furniture except two saddles and again which is to be sold likewise I give and bequeath to my Elizabeth Booth my wife one cow and calf the ballance of my cattle and mare and colt and all my working tools to be sold in forty days after my decese and my negro boy to be sold at the same time and the third of the money arising from the sale to go to Elizabeth Booth my wife and the ballance to be put on interest for my daughter Courtney and the Interest to raise and maintain her till she comes of age and my land I give to my two sons towit Will Booth and George Booth to be equally divided between them when them they come of age this I give from under my hand and seal this day and date above written I choose and desire Doctor William Wadlor and Benjamin Brown Esq. to serve as executors to my estate.

In The Name of God Amen I Elizabeth Boothe of the county of Albemarle being perfectly Sound in Mind & Memory, do hereby make this my last will & Testament. Hereby make this my Last will & Testament Hereby revoking all other wills heretofore by me made.

Item I give and bequeath unto my beloved Son William Boothe the House & Lott on which I at present reside (near the Town of Charlottesville) to him his heirs &c. forever. Also One Feather Bed and bedstead together with One blanket a pair of Sheets One pillow and a counterpane also One black Cow. But it is my Desire that Mr. Thomas Burton continue in full and undisturbed possession of the above House and Lott for the Space of Two years after my Decease.

Item One Cow called Sook and all my House hold furniture I give unto Mr. Thomas Burton for the use of himself and Lewis, Courtney, Joel, Thomas, Williamson for their use and benefit forever. Except after the Expiration of the Two years after my Death that my son William Shall have my large pott & one flat Iron.

Item the land which was given to me by Mr. Thomas Burton by Deed bearing Date the (blank) day of (blank) recorded in the District court of Albemarle, I request my Executor (hereafter named) to Sell at Twelve Months credit and the money arising therefrom to be put out at Interest for the benefit of my Sons Lewis, Joel, Thomas, and Williamson. If any of the above Named Sons Should Die before they become of Lawful age or have legal Issue their part is to go to their other brothers last named. But if all my last Named Sons Lewis, Joel, Thomas & Williamson Should Die before they become of Lawfull age or have Lawful Issue then it is my will and Desire that the whole Sum arising from the sale of said land with the Interest Should be given to Mr. Thos. Burton his heirs &c.

Item the debts Due me from Elijah Brown and Colo. John Nicholas I give to my Daughter Courtney to be put out at Interest by my Executor for her use (except Twenty Dollars to be paid to my son William arising out of the Money collected of Colo. John Nicholas which I wish to be paid him so soon as it can be collected. But if She Should die before She becomes of Lawful age or has legal Issue I give One Half to Mr. Thomas Burton and the other half, to my two Sons William & George Boothe Item the Money Due me from Thomas Wells Junr & John D. Durrett I give and bequeath unto my Two sons William and George Boothe to be equally divided between them To them their heirs &c forever. But if my son George Boothe should Die before he becomes of lawful age or have Lawful Issue then it is my will that my son William Booth have the whole Sum Due from the said Wells & Durrett to him his heirs &c forever. Item I Now Make and appoint Mr. John Kelly Executor of this my last Will and Testament Hereby revoking all other wills heretofore by me made. Given under my hand & Seal this 13th day of January in the year of our Lord eighteen hundred and thirteen.

To wit Imprimis my will and desire is that my body be decently buried at the discretion of my Executors hereafter named. Item I give and bequeath unto my Brother John B. Davis all my legacy that I am to have from my uncle Bartlet DavisÕs Estate of every description and all the whole property I now possess except one bed I give to my niece Jane Keaton and my wearing cloths my will is that my mother divide them amongst my three sisters as she thinks proper and all I ever expect to receive from my motherÕs Estate my will & desire is that my mother give that to my Brother John B. Davis lastly I appoint my friend Thomas H. Brown Executor of this my last will and testament whom I wish not to give security for his Executorship In Witness whereof I have set my hand and seal to my last will and testament this 8th day of September 1819.

In the name of God amen, I Lewis Shiflett of the county of Orange and state of Virginia being weak and infirm in body but of perfect mind and memory do make my last will and testament in the following manner and form, that is to say Item , I give unto my beloved wife Sally Shiflet during her widowhood all my whole estate both real and personal for her own use and benefit. Item, I give unto my son Joel Shiflet after the death or marriage of his mother the piece of land I now mention beginning at the new ford above the shop due north twenty paces till we come against the mill canal keeping this side the canal twenty paces to a small sasefig bush between two large rocks a little below my present stable thence north to my back line adjoining what is called the big survey including all my land below the said line down to Gentry's line, likewise after the death or marriage of his mother I give him a negro lad named Bob, likewise one bed and furniture belonging to the bed, likewise my largest trunk but provided my said son Joel Shiflet should die without a lawful heir the said property to come back to the said family again. Item, I give unto my daughter Sally Miller Shiflet after the death or marriage of her mother all my land west of my son Joel's line up to Ballard's line and north to my back line adjoining what is called the big survey, likewise after the death or marriage of her mother the following negroes one named Fountain, one named Lucy, likewise two feather beds and furniture belonging to the beds, likewise one beaurow and one small trunk and one side saddle to be bought for her at the expense of my estate, provided if she dies without a lawful heir the sd. property to come back to the sd. family. Item, I give unto my son John after the death or marriage of his mother one negro woman named Seaby and one bed and furniture belonging to the bed to him and his heirs forever. Item, I give unto my son Lewis Shiflett one bed and bed clothes. Item, I give unto my son Linsy one bed and bed clothes. Item, I give unto my daughter Nancy Saunders one bed and bed clothes to them & their heirs forever. These children, none of them to be able to claim anything till the death of their mother. Item, I give unto my grandson Benjamin Saunders after the death of his grandmother one young horse or forty dollars lawful money to him and heirs forever. Lastly, I make and ordain my beloved wife and son Joel Shiflet jointly executors of this my last will and testament and I hereby revoke, disallow, and disannul all wills and testaments by me heretofore made rattifying and confirming this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and seal this twenty-ninth day of March one thousand eight hundred and twenty four.

At a monthly court held for the county of Orange at the courthouse on Monday the twenty-sixth of July 1824 - This last will and testament of Lewis Shiflet deceased, was proved by the oaths of Enoch Seamands, Martin D. Harvey, and James Harvey witnesses thereof and ordered to be recorded - Joel Shiflet one executor named in said will came into court and refused the executorship and on the motion of Sarah Shiflet the executrix named in the said will who made oath thereto according to law and together with John Shiflet and Joel Shiflet her sureties entered into and acknowledged their bond in the penalty of four thousand dollars conditioned as the law directs, certificate is granted her for obtaining a probate thereof in due form. In the name of God Amen, I Richard Shiflett of the County of Albemarle & State of Va. being of sound mind and memory do make and order this my last will and testament, in manner and form as follows. First my will is that all my just debts if any be paid, second I lend to my wife during her life all my estate for her support, and at her death my will is that all my estate lent, except the land, shall be equally divided amongst my two sons Nathaniel & William and my son Blan Shiflett's widow or the representatives. I give to my son John Shiflett fifty-four dollars which he now owes me as his full proportions of my estate. I give to my son Nathaniel Shiflett, his heirs, assigns, after the death of his mother all my landed estate. I do constitute and appoint my son Nathaniel executor of this my last will. In witness wherof I hereunto set my hand and seal this 27th day of January 1827.

In the name of God amen I John Shobe of Albemarle County and State of Virginia being verrey old and infirm but still of sound mind and memory but calling to mind the mortality of my Body and that it is appointed one for man to die. I therefore do make this my last will and Testament in the manner and form following. To wit, First I desire all my Just debts should be paid. Item I give and bequeath unto my son John Shobe one yellowest Red Cow to him and his Heirs forever. Item I Give and bequeath unto my Daughter Polly Shobe one red Cow with white face to her and her Heirs forever. Item I Give and bequeath unto my daughter Gency Shobe one redish cow or Heifer red and white to her Heirs forever. Item I Give and bequeath unto my Daughter Palina Shobe one cow white and Brindle to her Heirs forever. Item I lend to my beloved wife Daras Shobe during her life all of the remainder of my property Land and stock. House Hold and Kitchen Furniture &c and after her death I wish my three daughter to have the youse of the same they being first named above to make the thing plain it's my wish for them to have the use of my land stock and all other property left by my wife at her decse during their single lives if they shall marry then it is my wis The land and all other property my be sold on twelve months credit and the money divided amongst my children above named lastly I make and constitute and ordain Peter Gibson executor of this my will and testament revoking all Wills heretofore by me maid rattafy this my last Will and Testament. It is believed this John Shobe is the father of Patience who m. Henry B. Shiflett, and that the Palina mentioned in the will is Patience.

In the name of God amen 1829 I John Shiflett senior of the county of Orange and state of Virginia being in sound mind and knowledge and knowing the meaning? of life and the certainty of death do make, constitute, appoint and ordain this to be my last will and testament revoking all others.

First of all I give unto my beloved wife Suseaner the tract of land that I bought of Thomas Snow, the tract whereon I now live during her life, and after her death the said tract of land to be set up at the highest bidder and sold and the money equally divided. Also the household and kitchen furniture and her choice of two cows and four sheep, also the stock of hogs and still and one horse.

Second. My will is for my lower tract of land to be divided by what is called the old horse branch and that to stand as the line without any surveyor and both sides of said land and said branch to be set up and sold to the highest bidder on a credit of twelve months with giving bond and approved security.

Third my will is that the tract of land I bought of John Snow under the foot of Rocky mountain whereon William Knight now lives shall be set up and sold to the highest bidder on the same terms as above and if my wife should get in distress the money that this tract of land brings whereon the said Knight now lives is to be given up to her for her relief.

Fourthly and lastly. My will is also that all the balance of my mountain land, in Orange and Albemarle should be set up and sold to the highest bidder on credit of twelve months by their giving bond with good security and out of that money all my just debts to be paid and the balance if any to be equally divided amongst all my children also the lower tract of land all the money rising from that to be equally divided and all that my wife can make after my decease shall be at her own will to do as she pleases with. I also decree that my son Coward Shiflett shall stand the executor of all my estate and my wife Suseaner. In witness whereof I have offered my hand and seal.

In the Name of God, Amen. I Honorius Powell, of the county of Rockingham and State of Virginia of perfect mind and memory but calling to mind the uncertainly of this life and that all men must die and hereby disannuling all former and other wills and testaments ehretofore by me made and declaring do make ordain, pulish, and declare this my last will and testament manner and form as following. That is to say: First and principally being sorry and penitent for my sins, I commit my sole into the hands of the Almighty God in whom and by whose mercy I trust to be and assuredly believe to be saved and my body I commit to the earth to be decently buried by and at the discretion of my executors herein after named and for the disposing of such temporal estate which it hath pleased God to bless me with. I do give and dispose of the same in manner and form as following, that is to say, Firstly I give and devise to my beloved wife Molly Powel a support on the places that my son Honorias Powel is to have during her natural life or widowhood and two negros Jude and Pink with necessaries of stock and household furniture for her use during her life or widowhood. Item. I have given to my son Benjamin Powel and my daughter Betsy Powel a tract of land called the grape thicket which I purchased from StClair Hirtley and that is to be their share of my land and estate. Item. I give and devise to my daughter Fanny Powel a tract of land containing fifty acres more or less which I purchased from Thomas Barber lying in Orange County on the side of the Bluerridge to the South of my house and the larger part of the tract which I purchased from Daniel Baugher containing one hundred and ninety-seven acres lying on the Blueridge to the South of the farm on which I now live and her boundary line on the North is to run with the Butter wood spring branch to her and her heirs and the Fanny Powel is to leave of the road that leads to the top of the Blueridge and it is my will that the best still and the barrels casks and standtubs for the use of my son Honorius Powel and my wife Molly Powel shall stay on the place and I also give to my son Honorius Powel the two tracts which I purchased from James Meadows containing by deed ninety seven acres lying on the west side of the Blueridge in Rockingham County and I also give to my son Honorius Powel three pieces of land which are to be taken of three different tracts. First, the remaining part of the tract which I purchased from Thomas Barber and which he purchased from Philipe Bush. Secondly, the part of the tract which lies North of the Butterwood Spring and Spring branch it being a smaller part of the tract which I purchased from Daniel Baugher, and thirdly the part of the tract which lies on the East side of the mountain road which was purchased by me from George and Nicholas Bougher. Containing in the whole tract two hundred acres and one rood lying in Rockingham County on the west side of the Blueridge it being the remaining part of a tract which I have given to my son Garrot Powell to my son Honorias Powell and his heirs forever. And it is my desire that my negros Samuel and Lewis with the remaining part of my moveable estate be sold at 12 months [unreadable]. [Unreadable] remaining part of the money is to be equally divided between my children above named and it is my desire that if either of my above named children shall die without an heir lawfully begotten of their body that their part of my above named estate shall fall to the other of my children to be equally divided among them and it is my desire that after my beloved wife Molly Powel shall depart this life or marry that her estate shall be [unreadable] and equally divided among named childring. It is my desire that if the title of my above tracts of land should not be good, the child to whom I have willed it shall receive its value from the sales of my moveable estate. Item 1st. I give and bequeath unto Polley Garrell formerly Polley Self all my land that I possess with all the appertainences thereunto belonging and my stock of every discription household and kitchen furniture etc. the above named property that is to say land, Horses, Cattle, Sheep, Hogs, etc. I give the same to Polley Garrell during the time she may remain a single woman, if she should Marry, I only give her two hundred dollars and the remainder to my children by her the said Polley Garrell, formerly Polley Self and after her decease or time of her single life of her the said Polley Garrell I devise and bequeath unto my children born unto me by by(sic) her as followeth.

Item 2nd. I give unto my daughter July Ann Catharine one hundred dollars as apart of her legacy in my estate.

Item 3rd. All the rest residue and remainder of my estate both real and personall goods and chattles of whatsoever kind I will and order shall appraised and equally divided between each and every of my children born unto me by the said Polley Garrell namely Madison, Burton, Jefferson, Virenda, Jam, and July Ann Catharine. I to them and their heirs forever. I give and bequeth unto sd. Cochran Gentlemen Justices of the Court of Augusta County now sitting in the sum of four hundred dollars to the payment whereof well and Truly be made to the said Justices and their successors we bind ourselves and each of us our and each of our heirs executors and administrators jointly and severally firmly by these presents sealed with our seals this 21st day of January in the year of our Lord 1842 and in the 66 year of the Commonwealth.

The Condition of this obligation is that if the said Givens Shiflett administrator of the Good Chattels and credits of Nancy Shiflett deceased do make a true and perfect Inventory of all land singul--- the goods chattels and credits of the said deceased which have or shall come to the hands possession or Knowledge of the said Givens Shiflett or into the hands or possession of any other person or persons for him and the service as made do exhibit into the County Court of Augusta when he shall be thereunto required by the said Court and such goods chattels and credits do well and Truly administer according to Law and further do make a ----- and true account of his actings and doings therein when thereto requried by the said Court and all the rest of the said goods chattels and credits which shall be found remaining upon the account of the said administrators the same being first examined and allowed by the justices of the said Court for the time being shall deliver and pay up to such persons respectively as are entitled to the same by said And if it shall hereafter appear that any Last will and Testament was made by the deceased and this can be proved in Court and the executor obtain a certificate of the probate thereof and the said Givens Shiflett do in such case being requried [to] render and deliver up his Letters of Administration then this obligation to be void else to reman in full force.

In the name of God amen: I James Herring Sr. of the County of Albemarle, being of sound mind and memory do make this my last will and testament as follows:
1st After the payment of all my just debts, the residue of my estate real and personal, I dispose of as follows. I lend to my beloved wife, Judy Herring, and my son James Herring Jr and during the natural life of my said wife all of my estate both real and personal, except the specific legacies, herein and after mentioned.
2nd I lend unto my daughter Nancy Herring during the natural life of my said wife Judy Herring, one negro girl named Louisa with her future increase, and at the death of my said wife, the said negro girl and her increase to return to my estate, and be divided with my other property as hereinafter mentioned.

Shiflett, 5th I give also to my granddaughter Henrietta McL. Shiflett five hundred dollars, 6th I give to Mrs. May Amiss one cow and all my necessary cloth, 7th I give to my granddaughter Laura E. Shiflett, Frances E. Shiflett and Harriett Shiflett the balance of my money after the collection of my bonds to be equally divided between them, 8th I give also to my grandson Joel M. Shiflett the balance of my stock of cattle and my mare Fany, 9th my grandson Homer A. Shiflett, Lilborn R. Shiflett and Thos. G. Item, I give and bequeath unto my beloved wife Susannah Shiflett all my land that I possess north of Taylor's Branch.

Item. All my land that I possess south of Taylor's Branch I have heretofore sold to my son Davis Shiflett for the just and full sum of thirty-five dollars. The above sume being less than the value of the land south of Taylor's Branch, the balance of it's value I give to my son Davis Shiflett for his share in full of my estate and the said thirty-five dollars that my son, Davis Shiflett owes me for the land that I sold him I desire that my executor see that it be collected and paid to James Simms, Esqr.

Item. All the land that I possess north of Taylor's Branch, after the death of my beloved wife, I desire that it should be sold to the highest bidder and out of the money ensuing from said sale, I desire that the bond that I gave to James Simms, Esqr., should be finished paid and the residue of the money from the sale of my land, I desire to be equally divided among my children that I name. My son, Davis Shiflett, excepted because I have aimed to give him his share in the manner before mentioned. The following children are the children that I intend to name. Richard Shiflett, Patsey MORRIS, Slaten Shiflett, Garland Shiflett, Fanny MORRIS, William Shiflett, Polly MORRIS, and my daughter Sally, I disire should have an equal share provided that she should marry to my liking or the liking of her mother and if not, I desire that my daughter, Sally, should not have any more than the law allows such children as are cut off from an equal share. As for my daughter Cata KNIGHT, I desire that my Executor collect and give her one dollar, then the balance of an equal share of the money ensuing from the sale of my land after the death of my beloved wife, should be equally divided between her children as they come of age as I do not intend for her husband William Knight to have any use of any of my estate but his wife, my daughter Cata's children I desire that they shall have their mothers share.

Item. I give to my beloved wife, one cow and calf and one heifer.
Item. I give to my beloved wife all my household and kitchen furniture.
Item. I give to my beloved wife four head of sheep.
Item. I give to my daughter, Sally three head of sheep in addition to her share in other cases.

Item 2nd It is my Will and desire that all my perishable property should be sold and after my just debts paid the balance of the money arising from the Sale of my Property after lending my loveing wife Catherine Knight one third of the money arising from such sale the balance equally divided among all of my chldren (namely) Iverson Knight, Thomas Knight, Mary A Shiflett, Mitchell Knight, Garland Knight, Frances Knight, James Knight.
Item 3. It is my Will that my land should be rented out until my youngest Son James becomes twenty one Years of Age and the money arising from the rest of my land after lending one third to my Wife Catharine Knight of the proceeds of the rest the balances to be equally divide amongst all my Children.
Item 4. It is my Will when my youngest Son James becomes of age, that my land should be sold to the highest bidder, and after lending my wife Catharine one third of the Money during her life and this residue of the money ariseing from the Sale of the land To should be equally divided amongst all of my children above named, but if any of my boys should take any kind disapation such as drinking or Gambling it is my Will that they shall not have one dollar of my estate.
Lastly. I appoint George A. Gentry Executor to my last Will and Testament revokeing all other Will. In Testimony whereof I set my hand and Seal. This 23rd day of Februrary 1854.

Your Commissioner reports that Catherine M. Shiflett on the 1st day of June 1857 exhibited before your Commissioners (through Benjamin Sneed her agent) her accounts as Guardian of Thomas G. Shiflett, Frances C. Shiflett and Harriet Shiflett for the years 1855 & 1856. That the Commissioner endorsed the said Guardian in the list of fiduciaries whose accounts were before him for settlement which was posted at the front door of the Court House of said County on the final day of June Court last. And on the date of this Report (ten days having elapsed since the said Account was mentioned in said list) made up and completed the foregoing accounts of the said Catherine Shiflett Guardianship of Thomas G., Frances C and Harriet Shiflett and on the 1st day of July 1856 finds a balance due the said Thomas G. of $4377.40 and a balance due the said Frances C. of $7680.28 and the said Harriet of $7895.53. The accounts are supported by satisfactory vouchers and herewith returned. The Commissioner has allowed the Guardian Commision on the Receipts for 185? because the accounts were placed in Commissioner WatsonÕs hand in time but he resigned without completing the service.

Your Commissioner further reports to the Court that he has ____ whether the said Guardian has given such bond as the law requires and whether it is in a penalty and with securities sufficient and finds the source unobjectionable and fully sufficient. In the name of God Amen, I, John Gentry of the county of Greene and state of Virginia being of sound mind and memory and considering the certainty of death and the uncertainty of life doth make this my last will and testament revoking all other wills.
Item 1. After all my just debts are paid and funeral expenses.
Item 2. I give to my wife Olley Gentry and my Grand daughter Martha Gentry four BalÕs. of corn, five bushels of wheat, two hundred weight of pork, and top fodder and shucks enough to winter her cow, one bee [illegible] and firsts provided my wife remains on the premises with my son James Gentry and if she leaves the provision (that is) the corn wheat and pork is to remain on the place for my Grand daughter Martha. I also give her a barrel of cider and half of my cabbages, and it is further my will that the marriage contract entered into between myself and my wife Olley Gentry formally Olley Shiflett shall be held sound and unvoidable that being recorded in the clerkÕs office of the County Court of Greene and state of Virginia.
Item 3. I also lend to my wife Olley Gentry my walnut cupboard during her life if she remain on the premises with the Earthenware that is in it and if she leaves or at her death to go to my Grand daughter Martha Gentry. Item 4. I give to my son Fountain Gentry the tract of land lying on the west side Lyntches river adjoining Wm. Shiflett Jr. (son to Tom) Austin Gentry & others. I also give to my son Fountain Gentry all the residue of my personal estate crops and all after my just debts are paid to him and his heirs forever.
Item 5. I give to my son Austin Gentry my negro woman Frunk her and her [illegible] to him and his heirs forever. Item 6. I give to my son John gentry the lower part of my land adjoining the land of Peter Gibson commencing at a large rock on the bank of river at what called the wash hole when crop fence comes to the river thence meandering with the crop fence to a blaze line thence with the blaze line up the ridge to James Carters line thence with the said line to Gibson line to the beginning to him and his heirs forever.
Item 7. I give to my son James Gentry my track of land on which I know live running with the said crop fence to said blaze line and joining Austin Gentry including the pattent land and big survey land runing with Stephen and Overton Shifletts line to John Gentry Jr. line extending to the blaze line that comes with Carter heretofore named as divideing line between my two sons John and James Gentry to him and his heirs forever. I also lend to my son James Gentry my negro boy Augustine during his life, and at his death to my Grand daughter Martha Gentry to her & heirs forever. In consideration I have left my son James Gentry more than the rest of my children that he shall take charge of my two old negroes Isum and Sooky and Matrian them out of the estate I left him and if he refuses to suport and take them the said old negroes they are to be suported out of what I will to him my son James Gentry.
Item 8. And if any of my children object to my will or trys overthrow it it is my will that they shall be cut from any estate and shall have nothing I have willÕd to them: lastly I appoint George A. Gentry & Peter Gibson my executors to my last will and testament all the land and negroes I will away my Executors is to have no commission on them . Given under my hand and seal this the 27th December 1857.

In the name of God, Amen, I John Shiflett of the county of Greene and state of Virginia, being weak in body but of sound mind and memory do make and ordain this my last will and testament in manner following to wit:

Item 1st-After my just debts and Funeral and Burial expenses are paid I give to my daughter Elizabeth Shiflett three hundred and fifty dollars to be applied as she may need it. Also the bed that she uses.

Item 2nd-I give to the bodily heirs of my daughter Tempey Shiflett the following sums. 1st I give Curtis Shiflett ten dollars. Also I give Harriet Shiflett twenty dollars. Also I give Reaves Shiflett ten dollars. Also I give Iverson Shiflett ten dollars. Also I give Anderson Shiflett ten dollars, which is and are the names of the bodily heirs of my said daughter, Tempey Shiflett.

Item 3rd-My will is that all the balance and remaining part of my estate shall be equally divided between my children (namely) My son, Turner Shiflett, my daughter, Christiny Shiflett, my daughter Winny T.[?] Shiflett, my daughter, Lurany MORRIS, and my daughter, Artimissa FRASIER, for them to use as they may choose with the exception of my daughter Artimissa Frasier and my daughter Lurany Morris, their portion of my estate shall be lent out at interest, and applied both principal and interest for land, provisions on clothing or doctors fees.

Item 4th-My will is, that if any of the legatees shall or should contest the validity of this will, they shall be deprived of all this interest in my estate, with the exception of one dollar and the rest of this be equally divided between the rest of the legatees.

Item 5th-I will that my children should come together and sell my property themselves as it will be much cheaper, and should they fail to to do, I hereby do constitute and appoint Austin Gentry, my executor, in witness whereof I have here unto signed my name and affirmed my seal this 6th day of December in the year of our Lord, one thousand eighteen hundred and fifty eight.

In the name if God Amen, I Overton Shiflett of the county of Greene & State of Virginia being in perfect mind and memory do make the following to be my last will & Testament 1st. I loan to my wife Sarah during her life two acres of land including my dweling home orchard and garden and a sufficiency of fire wood and necessary timber, which she is to take off of any potion of the tract of land I now live upon Also I give her the interest of three hundred dollars which I direct to be kept a sufficient amount and the interest paid her annually, also I give to my wife a choice cow & calf and bed and furniture 2nd. the residue of the tract of land which I now live on I give to my daughter Lucindy Herring (excepting ten acres of the uper part of it adjoining a tract of fifty acres further, after the death of my wife my said daughter Lucindy is to have the home & above loaned to my wife. 3rd. I loan to my daughter Cally Shiflett the aforesaid ten acres of land and forty four acres adjoining the said ten acres the former lying on flat top and after the death of said daughter Cally the said land I give to her children 4th. I give to the lawful children of my son Early Shiflett all of the land which I own east of the tract I now live on (and where my said son now lives containing some two hundred & fifty od acres divided from the tract I now live on by a line beginning in a box oak in the line between myself and Stephen Shiflett running up a fence along a gully between two barnes to a choped locust, and down the NW side of the tract to Davy Morris line but my said son Early and his wife Frances may have the use of said land during their lives for their support and their children. 5th. I give to my daughter Emily during her life and after her death to her children a part of a tract of land beginning at a chestnut at the bathing place on flat top running to three chestnut saplings a north course thence a west course to a chestnut at the calf pasture thence to a chestnut in BrownÕs line in the north side of the water ground. 6th. I loan to my son Henderson Shiflett during his life and after his death to his lawful children if any he should have if no children then to his next of kin on my side that part of tract loaned to my daughter Emerly on the south side of the line described for the portion of my said daughter Emerly. 7th. I give to my daughter Gincy during her life and then to her children the residue of the tract aforesaid given to my daughter Emerly & son Henderson, to be divided between Henderson and Gincy by a line beginning at a spring in a box oak running along the choped line to the three chestnuts. The lines described in dividing the aforesaid tract of land between my daughter Emerly Gincy and son Henderson I have heretofore choped or marked 8th. The residue of my property of every description I give equally to all my aforesaid children to be divided out in proportion to the advancements I have made to them which I have charged upon my book or memorandum. And I do hereby appoint my friend Thomas G. Garth to be executor of this my last will and testament In witness whereof I the said Overton Shiflett have to this my last will set my hand & seal this 26th day of August in the year of our lord 1859.
