In Debt This day came the Plts. by their Attorney and the Deft. being again solemnly called came not but made default, therefore it is considered by the Court the Plt recover against the Deft. and Francis Williams, his Security, nine hundred pounds of tobacco and forty one pounds and ten pence current money, the Debt in the Declaration mentioned and their costs by them in this behalf expended and the Deft. in mercy &c. But this Judgment, except as to the costs, is to be discharged by the payment of four hundred fifty pounds of tobacco and one pound and eleven pence current money together with Interest thereon to be computed after the rate of five per cent per annum from the 22nd day of February 1748 to the time of payment.O.C.     A Deed of quit claims To all persons to whom these presents shall come greeting Know ye that I Nutty Hearron of Rockingham county and state of Virginia for the consideration of five dollars received to my full satisfaction of Abslom Shiflett of the county of Orange and aforesaid state have re---sed released and quit claimed unto the said Abslom Shiflett all right and title which I the said Nutty Hearon in and to all the property left by my father William Hearon at his dest [should prob. be death] both real and personal of ---record whatsoever in Orange county and elsewhere and also my part of his claim as a soldier to have all my right and title in and to the said remised, released and quit claimed property with the appurtenances thereof to him the said Abslom Shiflett his heirs and assigns forever to his and their own proper use and behoof and furthermore I the said Nutty Hearon do for myself my heirs my executors and administrators covenant with the said Abslom Shiflett his heirs and assigns that upon and after the ensealing and delivery of these presents I the said Nutty Hearon will have and claim no right in or to the above property remised released and quit claimed premises.     To all persons to whom these presents shall come greeting know ye that I William Ham of the county of Orange and state of Virginia for the consideration of fifteen dollars received to my full satisfaction of Absalum Shiflett of the county of Orange and state of aforesaid have remiss, released and quit claimed unto the said Absalum Shiflett all rights and titles which I the said William Ham is and to a certain piece or parcel of land known by the name of James Herron tract and being the same bounded by Edward Knull, William Early and others containing estimation one thirteenth part out of one hundred and thirty four acres of land and being a in diseter to thirteenth part of by the same more or less To have all my rights and titles in and to the said remissed released and quit claimed premises with the appertenances therof to him the said Absalum Shiflett his heirs and assigns forever to his and, theirs ---- proper use and behoof and further more I the said William Ham do for myself my heirs, excutors and administrators covenant with the said Absalum Shiflett and his heirs and assigns that from and after the ensealing and delivery of these presents I the said William Ham will have no claim nor rights in or to the above remissed released and quit claimed premises. In testimony whereof I have hereunto set my hand and seal this 5th day of March 1829 in the year of our Lord 1829.

    This Indenture entered into the [blank] day of February in the year 1833 between Absalom Shiflett Edward Shiflett and Joise his wife and Winney Herring all of the County of Orange and state of Virginia of the one part and Felix Williams of the County and State aforesaid of the other part. Witnesseth that Absalom Shiflett, Edward Shiflett and Joise his wife and Winney Herring in consideration of the sum of one dollar of lawful money of this Commonwealth to them in hand paid by the said Felix Williams at or before the ensealing and delivery of these presents (the receipt whereof is hereby acknowledged) Have bargained and sold and by these presents do and each of them doth bargain and sell unto the said Felix Williams his heirs and assigns a certain part of a tract of land formerly owned by James Herring decd. adjoining the [lands] of Edward Rusell Edward Ship Parke Goodall Charles Parrott and William Early parts five in number together with all the appertunances thereunto belonging. To Have and to hold the said five parts of land unto the said Felix Williams his heirs and assigns forever and the said Absalom Shiflett Edward Shiflett and Joice his wife and Winney Herring for themselves and their heirs the said land with all and singular the premises and appertenances before mentioned unto the said Felix Williams his heirs and assigns free from the claim or claims of the said Absalom Shiflett Edward Shiflett and Joise his wife and Winney Herring either of them their or either of their heirs and of all and of every person or persons whatsoever shall will and do warrant and forever defend by these presents Witness whereof the said Absalom Shiflett Edward Shiflett and Joice his wife and Winney Herring have hereunto set their hands and seals the day and year first above written.

    Alexr. Herring vs. Benj. Harrison--Caveat against inclusive survey by defendant, made 12th September, 1801, in Rockingham, 1129 acres.

    Alexander Campbell and Jane his wife, of Rockingham County, vs. Herring--O. S. 176; N. S. 62--Bill 29th May, 1804. Jane is one of sisters of the full blood of William Herring, late of Rockingham, who died intestate. At time of his death complainants lived in Ireland, where the other sisters now reside, but shortly afterwards removed to Rockingham. Thomas Herring of Rockingham, claiming as half-brother of William, administered. Answer questions Jane's relationship to William. Thomas Heron left Ireland about forty years ago. There was a coroner's inquest on William's body. He was drowned. Agreement dated 16th August, 1792, between the subscribers and William Herron, schoolmaster. William is to teach an English school at following rates, viz: for £30 he is to teach for one year and to have his boarding, washing, and lodging. He is to teach the scholars well and truly in Reading, Writing and also Arethmetick, with care and attention. 3d October the school is to commence. Jacob Lincoln, Solm. (?) John Glendye deposes, 21st January, 1805, that he was acquainted with a certain William Herron in Ireland for some time before his death, being very aged when deponent first knew him. Deponent was the stated Minister of the Gospel in the Congregation of which said William was a member for about 20 years before deponent came to America. Said William was twice married and had children by the first marriage, particularly a son Thomas. Deponent never saw Thomas in Ireland, he having left there before deponent came to that congregation and had come to America, but since he came to America deponent has seen a Thomas Herron of Rockingham who he understands is the same Thomas. Deponent says he knew William Herron, Charity Herron, who married Thomas Kyle, since deceased, Jane Herron, who married Alexander Campbell (plaintiff), and Mary Herron, who married Thomas Mitchell, all children of William Herron by the second marriage. That William, Jr., frequently officiated as singing clerk to this deponent in his congregation in Ireland for several years. William, Jr., came to America some years before this deponent, but when deponent settled in Staunton, some time before William, Jr., died, the latter was an inhabitant and he officiated again as clerk for him in Staunton. Deponent knew Alexr. Campbell and his wife, Jane, in Ireland and since they came to America, and he celebrated their marriage. Taken at house of Nathan Griffith in Baltimore, 21st January, 1805.

    Alexr. Herring vs. Chipley et als.
    --O. S. 280; N. S. 99--Bill, 23d February, 1810, by orator for title to part. of his father's (William Herring's estate of Rockingham. Orator married in 1793 and his father gave him part leaving Elizabeth, his widow, and children, viz: Sarah Huston, wife of orator R. Huston, Elizabeth, Rebecca, Edith, Margaret and William S. Herring; and grandchildren, William and Elizabeth Chipley, infant children of William's daughter, Abigail, who married William Chipley and had died in Carolina in William's lifetime. Sarah and R. Huston were married in 1797.

    William Herring died in July 1806, intestate, leaving besides wife Elizabeth (Julie, I think her maiden name was Stephenson), children Alexander, Sarah, the wife of R. Huston, Elizabeth, Rebecca, Edith, Margaret, William S. and grandchildren William and Edith Chipley, the children of his deceased daughter Abigail, who married William Chipley; as disclosed in the son Alexander's bill of 23 February, 1810 vs. Chipley et als., petitioning for title to a part of his father's estate. In this Alexander was joined by his brother-in-law R. Huston. He recites that he married in 1793, and that his father had given him a part of his estate, but had never made title. It is further disclosed that Huston and Sarah were married in 1797.

    Elizabeth, the widow of William Herring, outlived her husband many years. She died in 1821, testate - Her will proven at February court, this year, was recorded in the single old will book now remaining of the early days of Rockingham. The edges of the book being badly charred in the bonfire through which it had passed, during the War of 1861-65, part of the writing is gone, but, so far as it remains, the will reads as follows---

Herring my best bed and furniture Viz a red Green & white Coverlid and white Counterpine two pair of fine cotton sheets and pillow Cases also half dozen silve....presented to me by the late Gabriel Jones Esq and all marked with....also Scott's family bible in four volumes & one hundred dollars to....heirs forever I give and bequeath to my Grandsons William H. Porter...Wilson Porter the sum of Fifty Dollars each (they being Children of my.....Margaret Porter) to them & their heirs forever. I give and bequeath to my....Elizabeth S.
