WAR OF 1812

DECLARATION OF A WIDOW FOR PENSION UNDER ACT OF FEBRUARY 14, 1871

County of Rockingham }ss:

            On this 24th day of April, one thousand eight hundred and seventy-five, personally appeared before me, J. T. Logan, Clerk , Clerk of the County Court, the same being a court of record within and for the county and State aforesaid, Milldred Shifflet aged about 81 years, a resident of Stonewall T., County of Rockingham, State of Virginia, who, being duly sworn according to the law, declares that she is the widow of Winston Shifflet, served the full period of sixty days in the 1 Military service of the United States in the War of 1812: and who was the identical Winston Shifflet, who 2 was drafted in Captain Thomas Miller's Company Col. Crutchfield's regiment, at Harvey's Muster grounds, on the ___ day of March, 1812, and was honorably discharged at Hampton, on the ____ day of June, 1812; that 3 he was at Hampton and was attached to the Lt Artillery; that her said husband was placed on the "Pension" of the United States and that she received the pension due the said husband up to the 24th day of December 1872, that she was married under the name of Mildred Shifflet to said Winston Shifflet in the Fall of ______, 1812, by Rev. Bingham at her father's house, county of Orange, State of Virginia, there being no legal barrier to said marriage; that her said husband died at his residence in Rockingham County on the 24th day of December, 1872, and that she has not remarried since his death; that at no time during the late rebellion against the authority of the United States, did she or her said husband adhere to the cause of the enemies of the Government, giving them aid or comfort, or exercise the functions of any office whatever under any authority, or pretended authority, in hostility to the United States; that she will support the constitution of the United States; that she is not in receipt of a pension under any previous act; that she makes this declaration for the purpose of being placed on the pension roll of the United States under the provisions of the act approved February 14, 1871, and hereby constitutes and appoints, with full power of substitution and revocation hat at no time during the late rebellion against the authority of the United States, did she or her said husband adhere to the cause of the enemies of the Government, giving them aid or comfort, or exercise the functions of any office whatever under any authority, or pretended authority, in hostility to the United States; that she will support the constitution of the United States; that she is not in receipt of a pension under any previous act; that she makes this declaration for the purpose of being placed on the pension roll of the United States under the provisions of the act approved February 14, 1871, and hereby constitutes and appoints, with full power of substitution and revocation N. W. Shular, of Inglewood, her true and lawful attorney to prosecute her claim and procure the issuance of a pension certificate to her. That her post office address is Inglewood of Rockingham, State of Virginia, and her domicile or place of abode is near the ----- of the Blue Ridge in Stonewall T.

Also personally appeared Byrd Shifflett, residing at Roadside and J. W. T. Samuels, residing at Roadside, person whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say: They were present and saw Mildred Shifflet, the claimant, sign her name (or make her mark) to the foregoing declaration; that they have every reason to believe, from the appearance of said claimant and their acquaintance with her, that she is the identical person she represents herself to be; and at no time during the late rebellion against the authority of the United States did she, or her late husband, adhere to the cause of the enemies of the Government, or give them aid or comfort; and that they have no interest in the prosecution of this claim.

SWORN to and subscribed before me this 24th day of April, A.D. 1875, and I hereby certify that the contents of the above declaration, &c., were fully made known and explained to the applicant and witnesses before swearing, including the words ___________, erased, and the words ___________, added; and that I have no interest, direct or indirect, in the prosecution of this claim.

State of Virginia, County of Rockingham, to wit: Personally appeared before me J.W.T. Samuels a Notary Public for said County in said State, Mrs. Olney Gentry, aged nearly seventy-seven years, a resident of Stonewall Township in said County who being duly Sworn according to law, declares that she was personally acquainted with Winston Shifflet, who died on the 24th day of December 1872, and that she knows Mildred Shifflet, the surviving widow of said deceased - that she was present at the wedding of the said Mildred Shifflet and saw her married to the said Winston Shifflet in the County of Orange by one Josiah or "Joe" Bingham - that they were married in the Fall of the year and that it has been about sixty-two or sixty-three years since they were married.

This day Turner Shifflet, aged about seventy-one years, a resident of Stonewall Township in said County and State personally appeared before me J.W.T. Samuels, a Notary Public for said County in said State, who being sworn according to law declared that he the said Turner Shifflet was present at the residence of Bland Shifflet when his daughter Mildred Shifflet was married to one Winston Shifflet by the Rev. Mr. Bingham - that he the said Winston Shifflet was married before he went to the "war of 1812" and that it has been over sixty-two years since the said Shifflet was married, further declarent saith not                                     Turner Shifflet

We, Thomas Powell and Louisa F. Lawson, residents of Stonewall Township in the County of Rockingham & State of Virginia, personally appeared before J.W.T. Samuels a Notary Public for said County and made the following Statements viz.: the said Powell states that he was present at the time of the death of Winston Shifflet, a pensioner of the war of 1812 and saw him, the said Winston Shifflet die - helped to lay him and shaved the corpse - that he died on "Christmas eve", the 24th of December 1872 - The said Louisa F. Lawson states that she assisted in making the burial clothes for the above named Winston Shifflet - that he died on the 24th day of December 1872 and that she was at his burial and saw him buried.
