My land and plantation where I now live on, and three Negroes Joe, Jeney and Hannor after my mother's deceas and my whole personal estate I lend to my loving wife Mary Powell during her natural life or the time she remains a widow. Afterward the land and plantation to my son James Powell.

The peac of land that goes by the name Mathew Jones's to the dividing line to my son Luesgording Powell.

The plantation and all the land in the fork of the two runs above Stephen Shiflett's to my son Colbe Powell.

800 acres as I had of John Mack Doner at the Tigers Valies upon Glady Creack to my four daughters equil divided between them four Mary Ann Powell, Betty Powell, and Mesineah Powell and Winey Powell.

Ruth Breaden I have given that peace of land where she now lives on.

That land where my mother Ann Powell lives on after my mother's decease to be set up and sold to the highest bidder. The money that comes for it be for paying my debts and for clearing and to pay off all rights and to have that patten land above mentioned in my four daughters names Mary Ann Powell, Betty Powell, Mesaniah Powell, Wine Powell in theys names four.

After my wifes deceas or widowhood my hole estate to be sold. at the highest bider and the money equile divided between all my children.

Know all men by these presents that we John Shifflett, Wm. Cox, and Thomas Jones are held and firmly bound to Wm. Bell, Rowland Thomas, Thos. Bell, Wm. Moore and Andw. Shepherd and Jarel White Gentlemen, Justices of the Court of Orange County, now sitting, in the Sum of Two Seven Thousand pounds curt. money to the payment whereof, well and truly to be made to the said Justices, and their Successors, we bind ourselves, and each ofus, our and each of our Heirs, Eecutores, and Administrators, jointly and severally, firmly by these Presents. Sealed withour Seals, this 25th Day of May Anno Domini One Thousand Seven Hundred and Eighty and in the fourth Year of the Reign of our Sovereign Lord King George III. Common Wealth.

Winney Powell and Betty Powell witnesses for John Powell against John Shifflett & al. On their motion it is ordered that the said Powell pay each of them six hundred and fifty pounds of tobacco for seven days attendance and for coming & returning forty miles from Culpeper County four times according to the law. Only two days attendance and one coming for each of them to be taxed in bill costs.

In the name of god amen I Honorius Powel of the County of Rockingham and State Virginia of perfect mind and memory but caling to mind the uncertainty of this life and that all men must die and hereby disannuling all former and other wills and Testaments heretofore by me made and declareing do make ordain Publish and declare this my last will and testament, manner and form as following, that is to say.

First and principally Being Sorry and pinetant for my Sins I commit my sole into the hands of the Almighty god in whome and by whose mercy I trust to be and absurdly Believe to be Saved and my body I commit to the earth to be deceantly Buried by and at the discretion of my Executors herein after named and for the disposing of such temporal estate which it hath pleased god to bless me with. I do give devise and dispose of the same in manner and firm as following that is to say

Firstly I give and devise to my Beloved wife Molly Powel a support on the place that my son Honorias Powel is to have during her natural life or widowhood and two negros Jude and Pink with necessaries of stock and household furniture for her use during her life or widowhood.

Item I have given to my son Benjamin Powel and my daughter Betsy Powel a tract of land called the grape thicket which I purchased from St. Clair Kirtly and that is to be their share of my landed estate.

Item I give and devise to my Daughter Fanny Powel a tract of land containing fifty acres more or less which I purchased from Thomas Barber lying in Orange County on the side of the blue ridge to the south of my house and the larger part of the tract which I purchased from Daniel Baugher containing one hundred ninety seven acres lying on the blue ridge to the south of the farm on which I now live and her boundary line on the North is to run with the butter wood spring branch to her and her heirs and the said Fanny Powel is to leave open the road that leads to the Shiflet place so that my son Jeremiah can go and return.

Item I give and devise to my Daughter Milly Shiflet my half of the tract of land which I purchased from Thomas Barber and which was taken up by Frances Kirtley containing in the whole one hundred and fifty acres more or less and lying in Rockingham County on the top of the blue ridge, and sixty acres of a tract of land which I purchased from Thomas Barber and which was purchased by him from Philip Bush and joining the land I purchased from Thomas Barber and which I have given to my Daughter Milly to her and her heirs forever.

Item I give and devise to my two sons Robert and Chapman Powel the land which I purchased from Isac Smith containing by pattent one hundred and seventy six acres lying in Orange County on the top of the blue ridge on the north side of the Swift run road and all my still tubs are to stay on the place for the use of my two sons just above named, to them and their heirs forever.

Item I give and devise to my son Jeremiah Powel the tract of land which I purchased from Stephen Shiflet containing one hundred and fifty od acres lying on the top of the mountain in Rockingham County to him his heirs forever.

Item I give and devise to my son Garrot Powel the tract of land which I purchased from John Yansey containing about one hundred and eighty acres lying in Rockingham County on the drain of the hawksbill creek and that part of the tract which lies west of the mountain road which I purchased from George Baugher and Nicholas Baugher executors of Daniel Baugher Dec'd. and a little part I swapped with James Rogers for to him and his heirs forever.

Item I give and devise to my son Honorius Powel the tract of land which I now live on and which was Deeded to me by Joshua Bush containing by deed eighty five and a half acres lying in Rockingham County on the top of the blue ridge and it is my will that the best still, all the barrels and stand tubs for the use of my son Honorius Powel and my wife Molly Powel shall stay on the place and I also give to my son Honorius Powel the two tracts which I Purchased from James Meddows, containing by deed ninety seven acres lying on the west side of the blue ridge in Rockingham County and I also give to my son Honorius Powel three pieces of land which are to be taken of three different tracts. First the remaining part of the tract which I purchased from Thomas Barber and which he purchased from Philip Bush Secondly the part of the tract which lies North of the butterwood spring and spring branch it being a smaller part of the tract which I purchased from Daniel Baugher and thirdly the part of the tract which lies on the east side of the mountain road which was purchased by me from George and Nicholas Baugher containing in the whole tract two hundred acres and one rood lying in Rockingham County on the west side of the blue ridge it being the remaining part of a tract which I have given to my son Garrot Powel, to my son Honorius and his heirs forever.

And it is my desire that my negros Crumel and Lewis with the remaining part of my movable estate be sold at twelve months credit and that after my just debts are discharged the remaining part of the money is to be equally divided between my childring above named and it is my desire that if either of my above named childring shall die without an heir Lawfully begotten of their body that their part of my above named estate shall fall to the other of my childring to be equally divided among them and it is my desire that after my beloved wife Molly Polly shall depart this life or marry that her estate shall be sold and equally divided among my above named childring.

It is my desire that if the title of either of my above tracts of land should not be good the child to whom I have willed it shall receive its value from the sales of my moveable estate. It is also my desire that my friend St. Clair D. Kirtley and my son Garrot Powel shall be the executors to my estate. Witness whereof I have hereunto set my hand and seal this twenty second of August in the year of our Lord one thousand eight hundred and twenty nine. This writing purporting to be the last will and testament of Honorius Powell deceas'd was presented in court & proved by the oaths of Absolum Shiflet & Stephen Shiflet, two witness thereto & ordered to be recorded and at August Court 1830 administration of all and singular the goods and chattles of the said H. Powell dec'd. was granted to Benjamin & James Powel in due form with the said will annexed they having entered into bond with security in the penalty of $2000 and made oath thereto as the law directs and it is ordered to be certified that Garrod Powel and Sinclair D. Kirtley the exec. named in said will refused to qualify as ex's of said will.

I, William Powell considering the uncertainty of this mortal life and being of sound mind and memory do make this my last Will and Testament in manner and form following (that is to say) First, I give and bequeath unto my beloved Grand Father the sum of fifty dollars, who is Absalom Shiflett of Albemarle Ct, Va. to be left in the hands of Jeremiah A. Early to be dealt to him as said Early may think he needs it. Second, I give and bequeath to my beloved Brother [blank] Powell, my sister Lemy (or Lomy) Shiflett, wife of Stinton Shiflett, all of my estate which I am now possessed of to be equally divided between them, also all my interest both real & personal in my Father's estate, who is Robert Powell dec'd between [blank] Powell & Lemy (or Lomy) Powell, wife of Stinton Shiflett.

I hereby appoint Austin Gentry sole Executor of this my last Will & Testament. In witness whereof I have set my hand and seal this the thirteenth day of May one thousand eight hundred & sixty two.

In the 1850 Albe. Co. Census household #414 has the following entry:
Absalom Shiflett 60 M Farmer (born ca. 1790)
Lucy Shiflett 2 F (born ca. 1828)
Cn-r Powell 21 F (born ca. 1829)
Nancy Powell 19 F (born ca. 1831)
William Powell 12 M (born ca. 1838)
Amanda Shiflett 12 F (born ca. 1838)

There is a March 31, 1829 Marriage Bond for Absalom's daughter, Nancy Shiflett, to Robert Powell, son of Honorias and Mary (Molly) Beasley Powell. Nancy Ann C. Powell married Mark Stinton Shiflett on Feb. 4, 1851 in Greene Co. She was born January 1831.

From the above will of William Powell and 1850 Albemarle Co. Census we can infer that :

  1. Absalom Shiflett's grandson, William Powell, Son of Robert and Nancy Powell, had a sister Nancy, called "Lemy or Lomy", who married Stinton Shiflet..
  2. Because Absalom is mentioned in William Powell's will in 1862, he is still alive, although he does not show up anywhere in the 1860 Albemarle County Census. Absalom is also listed as an heir to Stephen Palmer Shiflett in the original Bill of Complaint by Turner Shiflett in the Greene Co. Chancery cause involving the estate settlement of Stephen Palmer Shiflett in 1860. The summons issued for Absalom Shiflett to appear at the court hearing, dated Sept. 1861, is sent to the Albemarle County sheriff.
  3. We can probably safely assume the the three children listed in Absalom's household in the 1850 Albemarle county Census are his grandchildren and the children of Robert Powell and his deceased wife Nancy.
