Shiflett of the first and Mily Frazier of the second part all of Greene County Virginia, Witnesseth, that in consideration of three hundred dollars to them in hand paid by said Mily Frazier, the receipt whereof is hereby acknowledged, The said Nancy E. Shiflet, John C. Shiflett and Lucretia his wife, Jas. F. Jollet and Lucie Ann his wife, Nancy F. Shiflet, George Austin Morris and Susan C. his wife, Victoria J. Shiflet, hereby grant unto the said Mily Frazier with general warranty the following real Estate to wit: Two hundred acres more or less, Beginning on Lynches River at Henry Austins corner thence to Burr? Lanes line, thence with said Lanes line to Wyatt Mills' corner thence to Poison Nole? corner thence to pole hill corner thence to the beginning, the above land lies in the county and State aforesaid.

This Indenture made the 15th day of May in the year 1872 between John Shiflett Sr. of Albemarle County, Va. and Eliza (formerly Via) his wife of the one part & Amanda Via of Albemarle County, Va. of the other part, witnesseth that the said John Shiflett Sr. & Eliza his wife for and in consideration of one hundred acres of land off the north side [illegible] and five hundred dollars to James Shiflett, to them in hand paid by the said Amanda Via at or before the sealing and delivery of these presents, the receipt whereof they do hereby acknowledge and thereof acquit & forever discharge the said Amanda Via, her heirs and assigns by these presents have bargained, sold, released, & confirmed unto said Amanda Via and unto her heirs and assigns forever a certain lot, piece or parcel of land situate, lying & being in Albemarle County, Va. and containing three hundred and twenty-five acres, Bounded as follows, Viz. beginning at a forked poplar on head waters of Moorman's River N40 degrees E 122 poles to a spannish oak thence N 74 degrees E 80 poles to all small chestnut by a large stone thence N 13 degrees E 80 poles to a large chestnut, thence S 12 degrees West 48 poles to a chestnut, thence west 32 poles to a chestnut, thence S 60 degrees west 42 poles to a chestnut & red oak, thence S 84 degrees W 20 poles to a chestnut sapling, thence S 52 degrees W 200 poles to a chestnut red oak, thence South 114 degrees to a chestnut red oak, thence S 30 degrees W 96 poles to a Birch on a branch thence S 40 degrees E 52 poles to a maple, thence up the branch W 38 degrees E 173 poles to the beginning and a lot of sixty-two acres bounded as follows, Beginning at a maple corner to Dr. Brown & Givens thence S 66 degrees E 26 poles to the chestnut oaks & three hickory saplings, thence W 33 degrees E 82 poles to a chestnut oak & hickory, thence N 63 degrees E 40 poles to a [illegible] and chestnut oak, thence N 29 degrees E 100 poles to a small [illegible] chestnut oak, thence N 3 degrees E 80 poles to a hicory & spanish oak in A.R. Givens line, thence in his line S 40 degrees W 93 poles to a poplar on a branch, down the same 173 poles to the beginning, together with all the estate, right, title, interest and property, claims and demands whatever of them the son of [son of should probably be the word said] John Shiflett and Eliza his wife in law or equity or otherwise of, in, or out of the same.

To have and to hold said lot, piece or parcel of land and every part thereof with their appurtenances unto the said Amanda Via, her heirs and assigns forever and with the only proper use of her the said Amanda Via, her heirs and assigns forever; And the said John Shiflett Sr. for himself and his heirs and assigns and for and in behalf of the said Eliza, his wife and her heirs doth covenant, promise and agree to and [illegible] the said John Shiflett Sr., his heirs and assigns by these presents in manner and form following, to wit, that the said John Shiflett Sr. and his heirs [illegible] the said lot, piece or parcel of land and premises hereby granted or intended so to be with the appurtenances unto the said Amanda Via, her heirs and assigns against him the said John Shiflet Sr. and his heirs and against all and every person or persons whatever, will warrant and forever defend by these presents, In witness whereof, the said parties to these presents have hereto signed their names and affixed their seals the day and year above written.

Know all men by these presents that I, Jefferson Shiflett of the County of Shelby and State of Ohio have made constituted and appointed and do hereby make constitute and appoint J. T. Bray of the County of Greene and State of Virginia my true sufficient and lawful Attorney for me and in my name to sue for, recover and receive, to bargain, sell and release and convey to such person or persons, and for such sum or sums of money as my said attorney shall deem most for my advantage and profit all my undivided interest in that tract or parcel of land situate lying and being in the County of Greene and State of Virginia (it may be that a part of said tract lies in Albemarle County, State of Va) of which Jacob Shiflett of said County of Greene died seized and possessed and upon such sale or sales convenient and proper deeds with covenant or covenants general or special of warranty as to my said Attorney shall deem expedient in due form of law as my deed orders, to make seal deliver and acknowledge, and for me and in my name to accept and receive all and every the sum or sums of money which shall be owing to me on account of the said sale or sales, and upon the receipt thereof suitable acquittance or acquittances in my name and stead to make seal and deliver and generally giving to my said Attorney full power and authority touching the premises, to do execute proceed and finish in all things in as ample manner as I might do if personally present; hereby ratifying and confirming all lawful acts done by my said Attorney by virtue hereof, In testimony whereof I the said Jefferson Shiflett have set my hand and seal this 4th day of July 1872.

This Deed made the 15th day of December A.D. 1872 between J. T. Bray of the County of Greene and State of Virginia (the Attorney in fact of Jefferson Shiflett of Shelby County & State of Ohio) of the first part, and Wm. Patterson of the County of Augusta & State of Virginia of the second part, Witnesseth, that for and in consideration of the sum of two hundred dollars to the party of the first part in hand paid by the party of the second part, the receipt whereof is hereby acknowledged, the said party of the first part as granted bargained and sold, and does now by these presents grant bargain and sell to the party of the second part, the entire interest of the said Jefferson Shiflett in the land or lands of which Jacob Shiflett dec'd died seized and possessed lying and being in the said County of Greene and State of Virginia, it being the same land described in a duly executed power of Attorney from said Jefferson Shiflett to the party of the first part dated the 4th day of July 1872 and of record in the clerk's office of Greene County, Virginia. This Deed made the 30th day of December 1874 between Amanda J. Via, the wife of Ira Via, of the first part, and John Shiflett Sr. and Eliza his wife, of the second part, all of Albemarle County Witnesseth: That in consideration of an obligation, between Amanda J. Via and John Shiflett Sen., and wife, the sd. Amanda J. Via having obtained a deed to all the back of land owned by John Shiflett Sen. supposed to contain 325 acres, now releases to Eliza Shiflett for and during her life, one hundred acres of said land including the buildings and a sufficiency of timber and fine wood to keep said premises, this [illegible] laid off by survey if required by either party, revocing all former obligations, including the $500.00 bond which Amanda J. Via is to pay to James Shiflet.

From the Via Family List
Whereas John Shifflett Sr and Eliza Shiflett his wife, by deed dated 15th May 1872 and of record in Albemarle County Clerk's office in deed Book No 67 (69?) page 389 conveyed to Amanda Via a tract of land containing 325 acres in the Blue Ridge in said county and fully described in said deed And Whereas the consideration therefor recited in said deed was that said Amanda Via should pay $500 to James Shiflett, and that said John Shiflett Sr and his said wife should have one hundred acres of land off the north side of a tract of land called Trinadad. And Whereas it turned out that it was out of the power of said Amanda Via to make a good title to said 100 acres of said Trinadad tract And Whereas the said Amanda Via wishing to do full justice to said John Shiflett and wife, united in and signed a deed along with said John Shiflett & Eliza Shiflett his wife dated 30th December 1874 and recorded in Deed Book No 69 page 314 in Albemarle County Clerk's office in which last deed, owing to the inability of said Amanda Via to make title to 100 acres of the Trinidad tract, it was stipulated that Eliza Shiflett the wife of John Shiflett Sr should have 100 acres of the said 325 acre tract to be held by her said Eliza Shiflett for life, in satisfaction of the said 100 acres on the North side of the said Trinadad tract which said Amanda Via could not make title to And Whereas doubts had arisen as to the validity of said deed dated the 30th of December 1874 And Whereas it is the wish of all parties interested to settle all questions of doubt and to modify the terms of said last named deed in the mode and to the extent hereinafter set out.

Therefore this Deed made this 13th day of March 1879 between Ira Via and Amanda J Via his wife (the same Amanda Via above mentioned) of the first part and John Shiflett Sr and Eliza Shiflett his wife of the second part Witnesseth that In consideration of the premises and of ten dollars paid them, they the said Ira Via and Amanda J Via his wife do hereby grant and convey unto said John Shiflett Sr and Eliza Shiflett his wife for their joint lives and for the life of the survivor of them one hundred acres of land to be cut off from the western end of the 325 acre tract of land conveyed by said deed of John Shiflett and wife to said Amanda Via dated the 15th day of May 1872 in which said 325 acre tract is fully __ Said one hundred acres thereof in the Western end being the part thereof in which the holdings are situated and being the same 100 acres described & referred to in said deed dated the 30th of December 1874 and to be held by said John Shiflett Sr and Eliza Shiflett his wife during their joint lives and by the Survivor of said John Shiflett Sr and Eliza Shiflett for her life and at the death of said Survivor, said tract of 100 acres above described to revert and belong in fee, to the undersigned Amanda J Via her heirs or assigns forever and the undersigned John Shiflett Sr and Eliza Shiflett his wife do hereby accept the provisions of this deed in full and final satisfaction of all provisions and stipulations contained in either said deed dated 15 May 1872 or in said deed dated 31st December 1874 and especially do release and acquit said Amanda J Via from all __ or liability as to the 100 acres on the North side of the Trinidad tract which she was unable to convey, that is said Deed of 15 May 1872 is to remain in full force & effect, and this deed is accepted as a full and final settlement of any questions growing out of the failure and inability of the undersigned Amanda J Via to make title to 100 acres of the Trinadad tract And this deed is to stand in place and in lieu of said deed dated the 30th December 1874 Witness the following signature & Seals

Whereas the late John Lawson decd. died Seized of two tracts of land both lying and being in the County of Rockingham and State of Virginia, on the West side of the Blue Ridge. The one known as the George Baugher tract lies partly on the top of said Ridge and the other known as the Bartlet tract adjoining the former lies partly in the East side of whortleberry Mountain. Both containing by recent Survey 437 acres more or less. And whereas the said Lawson in his life time Sold to Theophilus Lawson of the Baugher tract about 75 acres adjoining Dr. Wood and others. And whereas the said Lawson at his demise left a widow (who is now dead) and eight children Surviving him. And Whereas the interests of said heirs are now owned by George Herring, Mary A. Shifflet, and Mary A. Wood, that is to say the said Herring owns four Shares, Mary A. Shifflett three and Mary A. Wood one Share, and Whereas each of said partys being anxious to Know the particular location of his interest in said ----- & having mutually agreed among themselves to make Deeds to each other to the land contained in the boundaries set forth, in the following Deed in order to make a final Settlement and quietus to the matters of dispute concerning each party's interest in said lands. And Whereas each party is perfectly Satisfied with the boundaries of said Deed and believe them to be right, proper, equitable, and Just Therefore This Deed made this 2 day February 1880 between George Herring & Margaret his wife of the first part Mary A. Shifflett of the second part & Mary A. Wood of the third part all of the County of Rockingham and State of Virginia; Witnesseth: The said George Herring and Margaret Herring his wife and Mary A. Shifflett for and in consideration of the sum of one Dollar to each of them in hand paid by the said Mary A. Wood, the receipt of which is hereby acknowledged, and for the further consideration of a full relinquishment of all her interest in and to all of that portion of the said Lawson's real estate included in their respective boundaries have granted, bargained, sold and conveyed and by these presents do grant, bargain, Sell and convey unto the said Mary A. Wood, all their right, title, Interest demand and expectancy in that portion of that said Estate contained and included in the following boundary; to wit Beginning at 2 white oak near a road on the West side of the Hawksbill, thence S51° E85 poles to a Small white oak Sapling and a Small Chestnut oak on the West edge of the Simmon's Gap turnpike Thence S16° E. 17 1/4 poles to a Rock on the West edge of said Turnpike near two hickories thence running a dividing line S79 1/2° W128 poles to a large Pine and two Small Saplins and a Chestnut Oak in the line of the old Survey on the side of Huckleberry Mountain thence N102° W120 poles to two Chestnuts and three Chestnut Oaks near a Hollow, Thence S83° E63 poles to a large Chestnut oak and a pine Stump on the side of a hill; thence S68° E14 poles to the beginning, containing 60 acres more or less; To have and to hold the said Lot or parcel of land wit the appurtenances thereto belonging to her and her heirs and assigns forever free of all encumbrances from either of the Grantors.

Also, the said George Herring & Margaret Herring his wife and Mary A. Wood for and in consideration of the Sum of One dollar in hand paid to each of them by the said Mary A. Shifflett the receipt whereof they do hereby acknowledge and for further consideration of a full relinquishment of all her interest in and to all that portion of the said Lawson's real estate included in their respective Boundaries herein described, have granted bargained, Sold and conveyed, and by these presents do grant, bargain, Sell and convey unto the said Mary A. Shifflett all their rights, title, Interest demand and expency in that portion of the said Estate containing and Included in the following boundary to wit: Beginning at a Gum and Small Chestnut in or near the Wyant line: thence running a dividing between the said Herring and the said Mary A. Shifflet S30° W25 poles to a large rock and a Small Poplar on the west edge of said Turnpike; thence N55° W14 poles to a Small white oak and two Dog woods on the West edge of said Pike; thence S27° W42poles to a Rock between a Shung? and a large Chestnut tree; thence S37° W26 poles to a Hickory Sprout and a Rock near Several Cherry trees; thence S6° W56 poles to a large Water Oak, a Small Hickory and a Small Spruce Pine on the South bank of the Hawksbill thence S46° W11 poles to a Small Gum on the Sinth? edge of said stream: thence S39° W12 poles to a Sycamore in said Stream and in the line of the old Survey; thence N45° W90 poles to a State Rock on a a hill side and thence [missing] Chestnut oak on the West edge of said Turnpike; thence S57° E54 poles to the beginning; containing 180 Acres more or less. To have and to hold the said tract or parcel of land and the appurtenances thereto belonging to her and her heirs and assigns free of any encumbrances through either of the Grantors.........

Likewise, the said Mary A. Shifflett & Mary A. Wood for and in consideration of the sum of One dollar in hand paid to each of them by the said Herring and Margaret his wife the receipt whereof is hereby acknowledged and for the further consideration of full relinquishment of all of their interest in and to all of the a portion of the said Lawsons Real Estate included in their respective boundaries herein described have granted, bargained, sold and conveyed, and by these presents do grant, bargain and convey unto the said George Herring all of their Right, Title, Interest, Demand and Expectancy in that portion of said Real Estate contained and included in the following boundary to wit Beginning at a Gum and Small Chestnut in or near the Wyant line thence S18° E6 poles to a Chestnut oak Stump, corner to John Wyant decd; Thence N88° E80 poles to two Red Oaks and a Hickory; thence S53° E150 poles to three Hickories on the Mountain, Absalom Shifflets corner, thence S36° W110 poles to two Chestnut trees thence S72° W94 poles to a Chestnut and Chestnut Oak Seller's corner Now Theophilus Lawson's near a Poplar and two Hickories (called for in the Bartlet [missing] on the west side of a path on said Lawson's old line; thence to said Poplar and Hickory (now fallen down) in the corner of a field near Theophilus Lawson's House; Thence West 6 [missing] poles to a Chestnut Oak and Hickory; thence N45° W75 poles to a Sycamore in the [missing] Hawksbill; thence reversing the bearing and running the several course and distances of [missing] line between the said Mary A. Shifflet and the said George Herring to the beginning [missing line]heirs and assigns forever free from all encumbrances from either of the Grantors Each of the parties hereto covenant to and with each other that they Warrant Generally the properly hereby conveyed Witness the following Signatures and Seals the day and date first above written.

This Deed of Gift made this 14 day of November 1881 between W.H. Shiflett of the 1st part and Eliza Ann Shiflett of the second part (Wife of the said Shiflett) All of the County of Greene and State of Virginia. Witnesseth that for and in Consideration of the Sum of one dollar in hand paid by the said Eliza Ann Shiflett to the said W.H. Shiflett, the receipt whereof is hereby acknowledged, and for the further consideration of the natural love and affection which the party of the first part bears to the party [of the second part]. Kindness that the said Eliza Ann Shiflett has done and bestowed to the said W.H. Shiflett doth hereby grant give and release unto the said Eliza Ann Shiflett all of my real estate and personal estate including horses, Cattle, Hogs, Sheep and Household and Kitchen Furniture, all of the corn crops, oats, Rye and wheat now on hand and that is now growing, all fodder and other long feed which I now have on hand or may hereafter have. It is further understood that in the event that the party of the 1st part should become helpless or unable to work, this property hereby conveyed or so much thereof as may be necessary shall be liable to a charges for support and maintenance. The parties further Covenant and agree that the said Hiden Shiflett shall act as the agent for the party of the second part in managing and taking care of the property hereby conveyed. This Deed made this 3d day of November 1881, between O.B. Roller, Commissioner of the circuit Court of Rockingham County in the Chancery cause of Nancy Crawford et als against St. Clair Shifflett, Curator &c of the one part and L.H. Shifflett of the other part both of the County of Rockingham and State of Virginia. Witnesseth that whereas by a ---- rendered at the May Term 1880 of the Circuit Court of Rockingham County in the Chancery cause of Nancy Crawford et als, against St. Clair Shifflett Curator &c. it was adjudged ordered and decreed that O.B. Roller Commissioner appointed under said decree should sell certain real estate in the bill and proceedings in said cause mentioned and herein after conveyed, at public auction at the front door of the Court house in Harrisonburg upon the following terms to wit: Costs of suit and Sale in hand and the remainder in three equal annual installments with interest from the day of sale, the purchaser giving bonds therefor with approved security, and the title to be retained as ultimate security.

And whereas in pursuance of the provisions of said decree the said O.B. Roller, Commissioner on the 19th day of November 1880, sold to L.H. Shifflett the tract of 8 A. 2 R. 6 3/4 poles at the price of $250.68 for the whole for which purchase money the said L.H. Shifflett paid the sum of one hundred and twenty dollars and Sixty eight-cents cash in hand, and executed his three bonds for forty three dollars and thirty three and one third cents- each payable at one two three years after date respectively with interest from date for the remainder with P.P. Shifflett and Henry Jones as surety, which said Sale was afterwards to wit at the October Term 1880, reported to said Court and ratified and confirmed by a decree then rendered in said cause. And Whereas by a decree rendered at the October term 1880, O.B. Roller was appointed commissioner to make a deed to said purchaser, for said tract of land when the purchase money should have been fully paid, and whereas the purchase money has been fully paid.

Now therefore this Deed Witnesseth that for and in consideration of the sum of one dollar cash in hand paid the receipt whereof is hereby acknowledged and of the premises herein before recited the said O.B. Roller Commissioner as aforesaid doth grant and convey with special warranty unto the said L.H. Shifflett a certain tract or parcel of land lying in Rockingham County commonly known as the St. Clair Shifflett tract containing 8 A. 2 R. 6 3/4 poles, bounded and described as follows, to wit: Beginning at the large rock in the South side of the Massanutten Road N71 1/4 E 6 poles to a rock in said road in the mouth of a lane thence down the land and crossing a deep mud hole with Jones line S 44 1/2 E 56 poles to a pile of Stines (or stones?) in Taylor's line, thence with Taylor's line and with the land S 37 W 43 poles to a stone in the side of a lane, thence N 17 1/4 W 45 poles to a stake, thence N 61 E 10 1/2 poles to a stake, thence N 31 1/2 W 27 poles and 14 links to the beginning.

Shifflett a Householder and head of a family hereby declare his intention to retain the benefit of his Homestead Exemption under the provsions of the Constitution of Virginia Artlicle 16 upon the following peoperty Viz--Fourteen Acres of Lnad withthe improvements, consisting of a Common frame House &c, and four acres of wheat in the ground. One 1 Horse Waggon, 1 Bedstead & Bedding, 1 clock, ---- and follder of four acres of land. Given under my hand this 30th day of October 1882.

This deed made this 7th day of February one thousand Eight hundred and Eighty-four, Between Solomon Shiflett and Winnie F. his wife of the one part and Thomas Frazier and Elizabeth Shiflett of the other part, all of the county of Green and State of Virginia, the said Solomon Shiflett and Winnie F. his wife in consideration of the sum of the sum of four Hundred dollars paid to them in hold, doth grant Bargain, Sell and Convey unto the said Thomas Frazier & Elizabeth Shiflett one hundred and thirty-five acres of land lying and being in the County of Greene adjoining the lands of Miley Frazier & Solomon Shiflett being a part of a plat of land surveyed by W. T. Deane, containing one hundred and fifty-five acres I reserving twenty acres above red Hill for my own use but the said Thomas Frazier is to have timber enough to keep up the fence of the lower Edge of the peach orchard field the line cutting off the twenty acres for my own use to commence at Coms (?) This Deed, made this 18th day of October one thousand eight hundred and eighty nine (1889) between Asher Dean of the County of Rockingham and State of Virginia, party of the first part and Lucretia Ann Shifflett the wife of Thomas S. Shifflett of the County and State aforesaid, party of the second part, Witnesseth, that the said Asher Dean for and in consideration of the sum of Eighty-five dollars, in current money of the United States, cash to him in hand paid by by [sic.] the party of the second the receipt whereof is hereby acknowledged, hath granted bargained sold, and conveyed, and by these presents doth grant, bargain, sell and convey with general warranty with the said Lucretia Ann Shifflett as a femme covert free from the marital relations of her said husband a certain lot piece or parcel of land and the appurtenances thereto belonging situated lying and being in the eastern part of the said County of Rockingham at the base of the Massanutten Mountain and bounded as follows. To have and to hold the said Lucretia Ann Shifflett during her life time & not to be liable for any debt or debts of her said husband and after her decease to become the property of James Wm. Newton Shifflett and John Thomas Sylvester Shifflett and William Jackson Viaral McCauley, the two former being children of the said Thomas S. Shifflett & Lucretia Ann his wife provided that the said mother survives her said husband. But if her said husband survives her, the said Lucretia Ann Shifflett, then the said Thomas S. Shifflett is to hold the said lot & appurtenances thereto belonging during the remainder of his life, and at his decease, the said lot and appurtenances thereto belonging shall by this conveyance belong to and become the property of the children before mentioned. This Deed made this 1st day of February 1892 between R.T.W. Duke special Commissioner as herein after set forth party of the first part and H. B. Shiflett of the county of Albemarle State of Virginia party of the second part Whereas by a decree of the Circuit Court of the County of Albemarle entered at the May term 1887 in the chancery cause entitled Shiflett vs Gardner & others herein depending it was among other things adjudged ordered and decreed that R. T. W. Duke who was thereby appointed Special Commissioner for the purpose should sell by public auction after certain advertisement and upon certain terms in the said decree fully set forth certain real estate herein described; and Whereas the said R.T.W. Duke pursuant to the said decree, did on the 4th day of July 1887 after having duly advertised the same in accordance with the terms of the said decree offer for sale by public auction the following described real estate to wit a tract of 115 acres of land near Booneville in Albemarle County which belonged to Amanda A. Thomas who was Amanda A. Gardner which was deeded to her by her father John Gardner by deed dated Sept 8, 1857.
At which sale the said H.B. Shiflett made the last and highest bid therefor and became the purchaser thereof at the price of four dollars per acre, and Whereas the said sale was duly reported to the court by the said Special Commissioner, and was by another decree entered in the said cause of the 14 day of Octo 1887 by the said court approved and confirmed; and Whereas the said H.B. Shiflett hath paid the whole of the purchase money which payment was duly reported to the Said Court, and whereupon by the same decree entered by the Said Court in the said cause on the 14 day of Oct 1887, the said R.T.W. Duke was appointed Special Commissioner to execute and deliver to the Said H. B. Shiflett a good and sufficient deed with special warranty conveying the said real estate to the Said H. B. Shiflett in fee simple. Now therefore This Deed Witnesseth. That for and in consideration of the promises and in obedience to the said last mentioned decree, the said R.T.W. Duke Special Commissioner as aforesaid does grant unto the said H.B. Shiflett with special warranty the real estate herein before fully described. Witness the following Signature and seal

Bruce of the second part being of Albemarle County and State of Virginia witnesseth that in consideration that two hundred and fifty dollars being paid down in hand and two hundred and seventy five dollars to be be paid in payments as follows one hundred dollars to be paid the first day of January 1896 and one hundred dollars the first day of January 1897 and the last deferred payment of seventy five dollars to be paid on the first day January 1898, for the above consideration Henry B. Shiflett and his wife of the first part do bargain and sell and convey to the said George W. Bruce a sertain parcel or lot of Land lying on the North side of Long mountain, county of Albemarle & containing one hundred and fifteen acres more or less, bounding as follows by the said George W. Wingfield of the county of Albemarle in the just and full sum of $39.29 (dollars) to the payment whereof well and fully to be made to the said J. R. Wingfield aforesaid his executors, administrators or assigns I bind myself my heirs executors and administrators jointly and severally firmly by these presents and I hereby waive the benefit of my homestead exemption as to this obligation. Shiflett, his wife, of the first part, and Micajah Woods Trustee of the second part, Witnesseth: In consideration of $5, the said H. B. Shiflett and Martha E. Shiflett hereby grant and convey unto said Micajah Woods with general warranty, the following real estate: all of that certain tract of land containing sixty one acres more or less, on which the grantors reside near Free Union in Albemarle Co. Va, adjoining the lands of Wm. Mooney, E. D. Carter and others, being the same real estate conveyed to said H. B. Shiflett by deed of Wm. G. Brown dated 5 March 1895, of record in the Clerk's office of the County Court of Albemarle County in Deed Book No. 103 at page 10, and which is also described in a plat thereof, of record in said office in Deed Book No. 99 at page 485 together with all easements and rights of way appertaining to said land as set out in a deed from Harmon & Southall Commissioners and L. G. Sullivan and wife to W. G. Brown recorded at page 483 in Deed Book No. 99 in said office. In Trust however, to secure the payment as they mature of two bonds of said H. B. Shiflett to John W. Fry Ð both dated 1st March 1879 Ð bearing interest thereafter one bond for $43.15 Ð payable to said Fry six months after its date Ð and the other bond for $261.25/100 payable to said Fry ten months after its date and both bonds containing waiver of benefit of homestead exemption by said H. B. Shiflett. In case of necessity for sale under this Deed, said Trustee Micajah Woods shall be governed by the provisions of section 2442 of the Code of Va. Except that the Trustees Commission shall be 5 per cent on the proceeds of sale, and the sale may be had either on the premises, or at Free Union, or in front of the Court House of Albemarle County, as the Trustee may determine on, after reasonable notice of the time, place and terms of sale. In case said bonds are paid off and there be no occasion for sale under this deed, all expenses incident to the release of this deed shall be paid by the grantor H. B. Shiflett.

Shiflett is justly indebted to John West in the sum of Five Hundred and forty-nine dollars and ninety-nine cents ($549.99) as is evidenced by his three bonds to said West, all dated this 26th day of January 1901, all bearing interest from date till paid, all containing a waiver of the Homestead Exemption, each for $183.33 Ð and payable respectively in 1, 2, & 3 years Ð after date, said Bonds being for the first, second and third deferred payment for 156 acres of land conveyed to said Shiflett by said West and wife this day. The said Shiflett is willing more fully to secure the prompt payment of said Bonds, principal and interest. Therefore This Deed made this 26th day of January 1901 by and between H. B. Shiflett of the first part and George Perkins of the second part witnesseth, That for and in consideration of the premises and of Five Dollars in hand paid by the said Perkins to the said Shiflett, the receipt whereof is hereby acknowledged, the said H. B. Shiflett hereby grants bargains, sells and conveys unto the said George Perkins a certain tract or parcel of land situated in the county of Albemarle on the west side of Mechums River, containing one Hundred and fifty-six (156) acres and being the identical land this day conveyed to said Shiflett by John West and wife, to whose Deed reference may be had for a further description of said land. To Have and To Hold said property, with all and singular the appurtenances thereunto pertaining, unto him, the said George Perkins, his heirs and assigns forever with general warranty of title. This conveyance is In Trust, however, to secure to the said John West the prompt payment of the three Bonds aforesaid principal and interest. The said Perkins, Trustee shall govern himself in all respects by section 2442 of the code of Virginia of 1887, except that in case of a sale under this Deed he shall be entitled to a commission of 5 percent of the gross proceeds of sale as his compensation and except also that there may be a sale under this Deed if there is default in the payment of either one of said Bonds. If a sale is made under this Deed before all that one or more of said Bonds, principal and interest, due and unpaid at the time of sale; and as to any one or more of said Bonds not then due, such credit shall be given as will correspond in amount and date with the maturity of the same after fully providing for the costs and expenses of sale and for all of said Bonds, so far as not paid at the time of sale, such terms shall be made as to the surplus of purchase money, if any, as the said Shiflett may direct, or, he failing to fix the same, as the said Trustee may determine. If a sale is made under this Deed on credit as to any of said Bonds, a lien on the property sold shall be given to secure the same, in addition to the bond of the purchaser. If all of said Bonds are fully paid without resort to this Deed then this Deed will be released at the proper cost of said Shiflett. This Deed and the Deed from said and wife conveying said land to said Shiflett are parts of the same transaction.

Shifflett, and her husband, the said George M. Shiflet as of twenty dollars to each cash paid to Charles Davis, Andrew J. Shifflett, and others and bounded as follows; Beginning at a White oak thence East 68° [blank] 19 poles to a Gum and Rock on the west side of the Simmons road, thence North [blank] 32 poles to two Chestnuts on the west side of the Road, thence west 2 1/3 poles to a chestnut, thence South West 7° 30 1/2 poles to a white Pine stump thence S.48 1/2° W.11 1/2 poles to the beginning containing 2 1/2 acres more or less. To have and to hold the said piece or parcel of land with the appurtenances thereto belonging unto the said Geo. M. Shifflet, his heirs and assigns forever, and to the only proper use and behoof to the said Geo. M. Shiflet. The said Geo. M. Shiflet shall have peaceable and quiet possession of the said Land free from all incumbrances. And the said parties of the first part Covenant that they have a right to convey the said land and that they will make such further assurances as may be necessary to perfect the title to said land. This deed made and entered into this 24th day of May 1902 between George M. Shiflett, Emma Keyton, Louisa Frazier, John C. Shiflett, Warren Shiflett, Bernard Shiflett, Florence Rains of the first part of the County of Greene and State of Virginia and Wm. R. Shiflett of the second part of the County of Greene State of Virginia, the said parties of the first part do this Day Grant, Bargain, Sell and Convey unto the Said W.R. Shiflett. Witnesseth that for and in consideration of the sum of $56.00 fifty-six dollars cash in hand paid by the said party of the second part to the parties of the first part the Receipt whereof they the said parties of the first part do hereby acknowledge to the said Second part, the Said first parties do sell and release and convey unto the said second part all of their right title and interest in a certain peace or parcel of Land lying being in the County of Greene State of Virginia Known as a part of the Estate of the Late Jacob Shiflett, Decd. It being the Land Owned by Wm. H. Shiflett, Decd. and Bounded as follows to wit: Beginning at a Beach at the Wall Rockes on the south west side of Mountain Road on Frazier mountain thence running in a South West direction to a Chesnut corner, thence running s.w. to the County line, thence with the County Line ---- W.R. Shiflett corner, a white oak, thence with the said W.R. Shiflett line to a Persimmon tree on the said Mountain Road thence with said Road to the Beginning. Containing 40 acres be the same more or less. It is distinctly understood by all parties to this Deed that the Said W.R. Shiflett and his assignees forever is to have a[ll] water right to the Spring or for watering of hereby conveyed. It being understood by the said Lessee Shiflett, Bernard Shiflett who owns the said lot of land above that was deeded to them by W.H Shiflett that the Said Land betw is to have a water right on said Lot of Land the said Parties is to build a lumber fence on the Lower Side of said lot up to the Spring the said WR Shiflett is to have and to hold the said land with all of its appurtenances forever the Said first parties hereby conveys all of their right and title unto the Said Second part and his assignees forever, witness our hand and seal this 24 day of May 1902.

Shiflett and his wife Martha Shiflett of the first part do bargain, sell and convey to the said Sanford K. Davis of the second part a certain parsel or lot of Land situated In the County of Albemarle State of Virginia on the west side of Mechums River containing one hundred and fifty six (156) acres and being the same land conveyed to the said Henry B. Shiflett by John West the said Henry B. Shiflett and wife do make a warantee deed to the said Sanford K. Davis for him to have and to hold free from all of her claims for ever. THIS DEED, made this 29th day of August, 1912, by and between Sanford K. Davis and Mrs. Birdie M. Davis, his wife, of the first part, and Preston Via of the second part,
WITNESSETH:-

That for and in consideration of nineteen hundred dollars ($1900.00) of which nine hundred dollars ($900.00) has been paid in cash, the receipt whereof is hereby acknowledged, and the residue, one thousand ($1000.00) is secured to be paid by the bonds of the purchaser and a trust deed securing the same, which trust deed and this deed form part of the same transaction, the said Sanford K. Davis and wife hereby GRANT, BARGAIN, SELL AND CONVEY with General Warranty of title unto the said Preston Via a certain tract or parcel of land in Albemarle County, Virginia, situated on the western side of Mechums River, containing one hundred and fifty-six (156) acres, more or less, and being the same land which was conveyed as follows, viz:
To John West by Virginia A. Pace and S. W. Pace, her husband, by deed dated 3rd of February 1899, recorded in the Clerk's Office of Albemarle County in Deed Book 113, page 160.
To H.B. Shiflett by John West and wife by deed dated 26th of January 1901, recorded in the Clerk's Office aforesaid in Deed Book 124, page 460.
And to Sanford K. Davis by H.B. Shiflett and wife, by deed dated 18th of October, 1904, and recorded in the Clerk's Office aforesaid in Deed Book 129, page 249.
Sanford K. Davis now resides and which is conveyed to the said Via by the said Davis and wife by deed of even date with this deed. And the deed from said Davis and wife to Via and this deed form parts of the same transaction, so that the wife of said Via need not unite, and does not unite in this deed.
TO HAVE AND TO HOLD SAID land with all and singular the appurtenances thereunto pertaining unto him, the said George Perkins, in fee simple.
But this conveyance is IN TRUST, however, to secure to the said Sanford K. Davis, his personal representatives or assigns, the prompt payment of the three bonds aforesaid, principal and interest. The said Perkins, Trustee, shall govern himself in all respects, by Section 2442 of the Code of Virginia of 1904, EXCEPT that in case of a sale under this deed he shall be entitled to five per cent (5%) of the gross proceeds thereof as his compensation; and EXCEPT, also, that if there be default in the payment of any one of the three bonds, aforesaid, principal or interest, then, at the option of the holder of said bonds, all of said bonds may become due and payable, regardless of the date of maturity named in said bonds, and thereupon this deed may be closed, for the whole debt represented by said bonds so far as the same may be unpaid at the date of default.
If all three of said bonds are paid without resort to this deed, then the said Davis will make such release of this deed as may be proper at the cost of the said Via.

Explanation of Homestead Exemption: “In 1873 an act of the Virginia General Assembly required agreements for agricultural loans ("advances") to be recorded at county courthouses. the act simply stated that if any person made advances to another person engaged in the cultivation of the soil, the person making the advance was to be entitled to a lien on the crops to the extent of the advances. These laws made it possible for renters to get cash or supplies by borrowing from local lenders. Section 14 stated, "The Lien shall not in any manner affect the rights of landlords to their proper share of rents or rights of distress, nor existing liens, nor shall it affect the advances rights to claim such part of his crops as is now exempt from levy or distress for rent." For example, a renter who had encumbered one-fourth of his crop for rent could not encumber the same one-fourth for any other purpose.

The second part of Section 14 referred to an earlier act of the General Assembly which enabled every householder to set aside up to $2,000 worth of property as exempt from levy or distress from rent, garnisheeing, or sale under any order or demand for debt. The act was designed to protect debtors from total loss, to prevent them from losing everything they had. This privilege, known as the "Homestead Exemption," had to be claimed, meaning the householder had to go to the courthouse and declare the property he wished to set aside and have it recorded as a deed.”

“This liberal and well-intentioned piece of legislation had little effect in Louisa County. In nearly every deed recording agricultural advances, the debtor waived benefit of the Homestead Exemption. Bedsteads and dressers, hoes and scythes, or livestock were often the only collateral a seeker of credit had. In order to get credit, these items had to be mortgaged too. The deeds which claimed the exemption constituted a small percentage of the total deeds of the county.”
