John Shiflett, Early White and John Shiflett, son of John
9 Mar 1841

Greene County Deed Bk. 2, p.8-9

An Indenture made the 9th of March in the year Eighteen Hundred and forty one between John Shiflett of Greene County of the first part, and Early White of said County of the second part, and John Shiflett, the son of John, of the third part, Whereas the said John Shiflett is greatly indebted to the said John Shiflett, the son of John, in the sum of Seven hundred dollars for tobacco and other things, which is n--ded by account the payment whereof the said John Shiflett is desirous to secure, and whereas the said John Shiflett, the son of John, has become security to the said John Shiflett in a bond to John Roberts for the sum of Seventy-five dollars dated in March 1840 and payable 12 months after date and the said John Shiflett is desirous to indemnify and secure the said Jon Shiflett, son of John, against all loss and injury from said securityship, As this Indenture Witnesseth, that for and in consideration of the premises and for the further consideration of one dollar in hand paid by the said Early White, the receipt whereof is hereby acknowledged, he the said John Shiflett does by these presents grant bargain sell and convey unto the said Early White his heirs and assigns, a certain tract or parcel of land situate in the County of Greene, bounded by the land of Nancy Shiflett, Rhodes Douglass, and James Harris, containing one hundred and seven acres together with all the privileges and appurtenances to the said land in any way appertaining, or belonging, to have and to hold to him the said Early White his heirs and assigns forever and the said John Shiflett for himself, his heirs, executors and administrators does warrant unto the said Early White his heirs and assigns, that he the said John Shiflett shall and his executors and administrators shall warrant and defend the same to the said Early White his heirs and assigns forever against the lawful claim or claims of all persons whatever and also all my perishable goods: I the said John Shiflett, consisting of 7 Horses, 11 sheep, 2 cows, 4 hogs, Waggon and ----, Household and kitchen furniture of any name or description make one ----------to the said Early White his heirs and assigns forever against the lawful claims and demands of all persons ---- trust --------- that the said Early White his heirs and assigns shall permit the said John Shiflett to remain in quiet and full possession of the said tract of land and its appurtenances and to take the profit thereof to his own use, and also all the perishable property here mentioned to his own use, until default be made in the payment of the said above mentioned sums of money in whole or in part - say five years in peaceable and quiet possession of said land, and perishable property, the said John Shiflett and then if default should be made at the expiration of said five years by said John Shiflett, John the son of John shall request the said Early White, his executors, administrators or assigns to sell the said land and its appurtenances, and the said perishable property, or such part as shall be sufficient for the purpose at public auction to the highest bidder for ready money after and having fixed the time and place of sale at his own discretion, and given one month notice thereof in one or more papers printed in the City of Richmond and also notifies the same at the door of the Court House of Greene County at least one month and -nt of proceeds of sale shall after satisfying the expenses thereof and all the expenses attending the execution of this trust, pay to the said John Shiflett, his heirs, executors, administrators, or assigns. But if the whole of the said debt, and accruing interest shall be fully paid off and discharged to the said John, son of John, his heir, executors, administrators, or assigns on or before the expiration of said five years, so that no default of payment of said debt is made, then this indenture shall be void, or else remain in full force. This Indenture made this twenty eighth day of July One thousand eight hundred and forty one between Henry B. Shiflett of the first part and John Dunn of the second part and Candes Shiflett of the third part Where as the sd. Henry B. Shiflett is justly Indebted to Candes Shiflett in the sum of two hundred dollars to be paid in four installments of fifty dollars each the last being December the twenty fifth one thousand eight hundred and forty four as by Bonds more fully appears which debts John Dunn and Henry B. Shiflett is willing and to secure now this Indenture

Witnesseth that for and in consideration of the premises and also for the further consideration of one dollar lawful money --- to the sd. Henry B. Shiflett in hand paid by the sd. John Dunn and before the ensealing and delivery these presents the receipt is hereby acknowledged the sd. Henry B. Shiflett hath given granted bargained and confirmed and by these presents do give grant bargain sell and confirm unto the sd. John Dunn his heirs &c a certain tract lot or boundary Land in Albemar County and Greene containing by estimation sixty five acres to be the same more or less the sd. lot or boundary of land is bounded by Richard Harvey, Richard Shiflett, sd. Henry B. Shiflett, and Trice Shiflett, and Nancy Simms.

Beginning on a locust tree in sd. Harvey line then to Richard Shiflett to sd. Henry B. Shifletts line thence with sd. Shifletts line to Trice Shifletts line thence with Trice Shifletts to Nancy Simms thence with said Simms line to the beginning with all and singular the appurtenances unto the sd. tract or boundary of land to have and to hold the hereby granted land and premises with all its appurtenances hereby conveyed unto the sd. John Dunn his heirs &c to the only use and behoof of the sd. John Dunn his heirs &c ad the sd. Henry B. Shiflett for himself his heirs &c doth hereby covenant promise and agree to and with John Dunn his heirs &c in manner and form following that is to say the sd. Henry B. Shiflett his heirs &c. the aforesaid tract or lot of land and premises with all its appurtenances conveyed unto sd. John Dunn his heirs &c. against all persons whatsoever shall and will war rant and defend by these presents upon trust neverthe less that the sd. John Dunn his heirs &c shall permit the sd. Henry B. Shiflett in quiet and peaceable possession of the sd. land and premises with its appurtenances and take the profits thereof to his own use until default be made in the payment of sd. sum of two hundred dollars either in whole or in part and then upon the further trust that he or his surviver or his heirs shall ad will as soon after the happening of each default of payment as he may think on the sd. Candes Shiflett her heirs &c shall request sell the sd. tract of boundary of land and premises as the trustee or his representative hereby authorized to act for ready money at public auction, and out of the money arising from such sale shall after satisfying the charges thereof and other expenses attending the premises pay to Candes Shiflett the sum of two hundred dollars with lawful interest and the balance if any shall pay to the sd. Henry B. Shiflett his heirs &c but if the whole sum of two hundred dollars be paid off with charges to sd. Candes Shiflett or her heirs on or before the twenty fifth day of December one thousand eight hundred and forty four when the sum is payable then this Indenture to be void or else to remain in full force and virtue In witness whereof the sd. parties to these presents have here unto set their hand and affixed their seals the day and year first above written

This indenture made this 11th day of October one thousand eight hundred and forty one between John Shiplett of Albemarle of the one part, and Fountain Mooney, of the other part: Witneseth for and in consideration of the sum of two hundred and thirty dollars paid by the said Fountain Mooney unto the sd. John Shiplett the sd. John Shiplett to bargain and sell unto the said Mooney, a certain tract or lot of land containing, by estimation one hundred and twenty six acres and a half, to the same more or less lying and being, in the County of Greene on the waters of Lynches River and is bounded as followeth to Wit, Beginning on Portes[this word is underlined, which means it has been spelt incorrectly by the transcriber] Gibsons line near a Mill thence with said Gibsons line to Michael Shifletts line thence to sd. John Shipletts line, thence to John Shiflett commonly called Brock (Buck?) Shiflett, thence with the meanders of the sd. River to the beginning. To have and to hold sd. tract or lot of land with all and singular the appertenances unto the said Thornton Mooney and to his heirs and assigns forever, from the claim or claims of all and every person that the said John Shiflett do warrant and forever defend the right and title of said land unto sd. Thornton Mooney and his heirs forever. In witness I have herunto set my hand and seal this day and date first above written.

This Indenture made and entered into this 11 day of December 1841, between James E White of the first part, and John Shiflete (Stiller) of the second part, and of the County of Greene and State of Virginia. Witnesseth that for and in consideration of the sum of one dollar, to him in hand paid by the said John Shiflet the not[e] whereof is hereby acknowledged has this day as trustee sold to said Shiflett a certain tract or parcel of land supposed to contain one hundred and [eleven?] acres be the same more or less and bounded as follows Viz Beginning on the Widow Douglas' line and running to Hucksteps road, on the South Side of the Mountain to Jos Morris' line, down the Yellow branch to Lynches River, down said River, to James Harris line, with said Harris' line to Nancy Shifletts line, and with said line to the beginning. This Indenture made and entered into this 25 day of July one thousand eight hundred and forty two Between George Martin and Elizabeth his wife of the first part and Absalum Shiftlett of the second part. Witnesseth that we George Martin and Elizabeth his wife in consideration of the sum of one thousand Dollars to us in hand paid, have granted, bargained, sold and delivered to the said Absolum Shiftlett one certain tract or parcel of land lying in the County of Albemarle and State of Va and adjoining the land of Francis Durrett, Thomas Hall, James Keyton, James T Early, Daniel Tonys? and William Dowell and containing two hundred and seventy eight and three forths acres more or less. (The said Martin reserving to himself the road, now running from Richard Birkheads Mill down the Creek to Francis Durretts line to him and his heirs forever( the sd Absolum Shiftlett to hold the above tract or parcel of Land forever for his own use & Benefit the true and lawful title of which we the said George Martin and Elizabeth his wife warrent & Defend to the sd. Absolum Shiftell free from the claims of ourselves our heirs etc. and of all persons whatsoever. Given under our hands and seals the above day & date.

This Indenture made this 6th day of October one thousand eight hundred and forty two between Smith Shiflett Albemarle County and State of Virginia of the first part, James Shiflett of sd. County of the second part and John Shiflett of the third part. Whereas the sd. Smith Shiflett is justly indebted to Jno Shiflett in the sum of one hundred and ten dollars fifteen cents as by bond (bearing and with the Signature at demand?) the said Smith Shiflett is willing and desires to secure. Now this Indenture Witnesseth that for and inconsideration of the premises and also for the further consideration of one dollar lawful money of Virginia to the said Smith Shiflett in hand paid by the samed James Shiflett at or before the ensealing and delivery of these presents, the receipt whereof is herby acknowldged hath given granted, bargained, and sold unto the said James Shiflett forever, all the hereinafter named property that is to say, one horse, three head of cattle, seven head of hogs, two beds and furniture, crop of tobacco, corn and oats, etc., household and kitchen furniture. To have and to hold the hereby granted or intended to be granted - ----- to be granted unto the sd. James Shiflett his heirs etc., to the only use and behoof of the said James Shiflett his heirs etc. doth hereby covenant promise and agree with the said, that Smith Shiflett shall remain in peacable possession of the property hereto conveyed. Upon trust that the said James Shiflett shall and will so soon as John Shiflett or his heirs etc. request sell to the highest bidder the above named property and out of the monies arising from such sale, shall after satisfying all expenses attending the same, pay to the said John Shiflett the sum of one hundred and ten dollars and fifteen cents with interest and the balance if any shall pay to the said Smith Shiflett or his heirs, but if the said Smith Shiflett do fully pay and discharge said debt, then this Indenture to be void, else to remain in full force and virtue. This Indenture made this 12th day of October 1842. Between Henry B Shiflett and Patience his wife of Albemarle County Virginia of the one part, and Louden Shiflett of said County etc. of the other part. Witnesseth that the said Henry B Shiflett & Patience his wife, hath for and in consideration of the sum of one hundred and twenty-five dollars to them in hand paid by the said Louden Shiflett, the receipt whereof is hereby acknowledged have given, granted, bargained and sold unto the said Louden Shiflett and his heirs forever, a certain lot or boundary land lying and being in Albemarle County and Green, on the waters of Lynches river, on the County line Mountain, and supposed to be fifty acres, be the same more less, and is bounded as follows to wit Beginning at the lower end of the old May Orchard, on a persimon tree and pine, cornering in Trice Shifletts line, thence a new line northward to a chesnut oak in Richard Shiflett's line, thence with said line to John Gentrys line, thence with said Gentry's line to Nancy? Simmes line, thence with said Simes line to Trice Shifletts line thence with said Shifletts line to the beginning. To have and to hold the aforesaid land and premise with all its appurtenances unto the said Louden Shiflett and his heirs etc. forever free from the Claims of the said Henry B Shiflett and Patience his wife and all other persons whatsoever claiming under him them or either of them forever, that the said Henry B Shiflett hath good right to sell and convey the same unto the said Louden Shiflett and his heirs forever and that the said Henry B Shiflett & Patience his wife will warrant and forever defend the right & title unto the above named land and premises unto the said Louden Shiflett and his heirs forever. This Indenture made the 12th day of October 1842 Between Louden Shiflett of Albemarle County Virginia of the first part and John Dunn of the second part and Candes - of the said County and State aforesaid of the third part. Whereas the said Louden Shiflett is justly indebted to Candes Shiflett in the sum of one hundred and twenty three dollars as by bond bearing equal date, the said Louden Shiflett is willing to secure. Now this Indenture Witnesseth that for and in consideration of the premises and for the further consideration of one dollar lawful money of Virginia to the said Louden Shiflett in hand paid by the said John Dunn at or before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, he the said Louden Shiflett hath given, granted, bargained and sold unto John Dunn his heirs etc. forever a tract or lot of land or premises, supposed to be fifty acres to be the same, more or less, on the waters of Lynches river Albemarle County On County line mountain adjoining the lands of Henry B. Shiflett , Richard Shiflett, John Gentry, Nancy Simmes, and Trice Shiflett. To have & to hold the above named land and pemises unto the sd. John Dunn and his heirs forever, doth hereby convenent promise and agree with the said John Dunn his heirs etc. in manner and form following. that is to say that he said Louden Shiflett his heirs etc. shall and will warrant and forever defend by these presents that the said John Dunn and his heirs shall permit the said Louden Shiflett to remain in peaceable possession of the land & premises hereby conveyed. Upon trust that the said John Dunn his heirs etc. shall and will so soon as Candes Shiflett or her representatives shall request or default be made in payment either in whole or in part, sell the above named land and ------- or such part thereof as the trustee shall think proper or sufficient to satisfy [missing?] to sell to the hightest bidder for ready money at public auction and having given legal notice and out of the money arising from sale, after satisfying the charges thereof, and other expenses pay to Candes Shiflett or her ligal representatives the sum of one hundred and twenty five dollars with ------- interest and the balance of any pay to the said Louden Shiflett his heirs etc. But if the said Louden Shiflett do fully pay and discharge said debt then this Indenture to be void, --- to remain in full force and virtue. John Davis to Peachy Davis

Know all men by these presents that I John Davis of the County of Greene and State of Virginia bearing in mind the love and affection I have for my Daughter Peachy Davis and for her services rendered to me, I give and grant unto my Daughter Peachy Davis a certain tract or parcel of land being and lying in the County of Greene adjoining my old track land and the land of James Morris and others containing thirty acres more or less. I give also to my daughter Peachy Davis the third part of my land I am now living on, at the death of my wife Nancy Davis for which I give to her during her life. The residue of my land is under deed of Trust, It is also my will and desire that my Daughter Peachy Davis should have and hold unmolested the property that she has now in possession on my premises (Viz.) One cow, Sow and four shoats, a C-----, one flax wheel, three feather beds and Heads, counterpins, sheets &C., one chest, one f--ing table, one cupboard, all the household kitchen furniture to tedious to mention. This last named property is propirty that I have no claim to nor never had. I only name it as it is my house on my possessions and there may not be no contention concerning the last named property at my death. The balance I have given her, I only consider as compensation for her services rendered to me, as witness my hand & seal this day & date above written.

This Indenture made and entered into this 24th day of November One Thousand eight hundred and forty two, between William Shiflett of the first part, Wm. G Dunn of the second part, James Shiflett and M A Dunn [--?] of the third part; Witnesseth, that the said William Shiflett for and in consideration of the sum of one dollar to him in hand paid by the said William G. Dunn the receipt where of is hereby acknowledged, hast granted, bargained, and sold, and by these presents doth grant, bargain and sell unto the said William G. Dunn the following property To Wit: One Tract of Land containing three hundred acres, adjoining the lands of James Shiflett, Chapman Powell and others, one Mare, Eight head Cattle, two beds and furniture and all his house furniture, plantation tools etc. also crop of Wheat, Corn and Tobacco; To have and to hold the said property to him the said William G. Dunn his heirs and assigns forever free from the claim or claims of all and any persons or persons whatever. Upon the following conditions Viz: Wheras the said William Shiflet is justly indebted to James Shiflett the sum of Four hundred dollars due 1st September 1842, and furthermore the said William Shiflett is justly indebted to M. A. Dunn --? the sum of One hundred dollars due the 1st October 1842, Now the true meaning and intent of this conveyance is such that should the said William Shiflett well and truly pay the above named sums, on or before the first of September One Thousand Eight Hundred and Forty Seven, then this indenture to be of no further use force or effect, whatever, but in case failure occur either in part or in whole of what is hereby intended to be paid by the said William Shiflet, then the said Wm. G. Dunn at the request of James Shiflett and M. A. Dunn --? their executors, adm. shall advertise the said property at some convenient public place in the neighborhood, the time and place being fixed by said Trustee at his own discretion ----? to sell for the highest price that will be given in ready money. And after paying the above named debts with legal interest theron and cost attending the same, the balance if any to be paid to said William Shiflett or his legal representatives. Articles of Agreement between Candes Shiflett and Henry B. & Moton Shiflett

Articles of agreement made and entered into between Candis Shiflett of Green County Va of the first part and Henry B. Shiflett and Moton Shiflett of the second part. Witnesseth that the said Candis Shiflett for and in consideration of a life maintainance hath given over to said Henry B Shiflett and Moton Shiflett all her property real and personal goods chattels that the said Candis Shiflett possess, say all her land and premises in Albemarle and Green counties, including the lot of land and house whereon said Candis Shiflett formerly lived and all Bonds both due and undue: All the above named property of every description the said Candis Shiflett do By these presents make over and give possession to said property for the sole benifit of the said Henry B. Shiflett and Morton Shiflett ---- their heirs forever. And for and in consideration of the above the said Henry B. Shiflett and Moton Shiflett do bind themselves & Heirs and etc. all just ditto due and demand that may come against the said Candis Shiflett and jointly to maintain through life and comfortably through life keep and provide for as far as their limited abilities will admit of, say feeding clothing, lodging etc. each one of the second part do hereby agree and bind themselves either to other to bear an equal portion of The expences that may accrue, and that the said Morton Shiflett shall enjoy possession of the lot of land and premises whereon he now resides the lot land to be appraised and added to the amount of bonds, and the rent or rents of the lot of land now occupied by Trice Shiflett which by Joint agreement shall not exceed ten dollars per Year, and the sum total after paying, all demands shall be yearly divided The said Henry B Shiflett do agree that that the lot of land as is named in these articles shall be the property of the said Morton Shiflett and his heirs forever, the price on said to stand at one hundred and twenty five dollars. He the said Henry B. Shiflett and Morton Shiflett do agree that the price of said land say one hundred an twenty five dollars shall be added to whatever sum may remain after paying the debts as above named, out of the bonds above named and made a sum total. Thus the bond sum Total shall be equally divided between the said Henry B. Shiflett and Morten Shiflett, if the land money should be over one half the above named sum, then Morton Shiflett shall pay over to Henry B Shiflett and for the true performance of the above articles of agreement the parties do bind themselves in the penal sum of four hundred dollars either to other for the true performance of the same. Given under our hands and seals this 14 day of January 1843.

This Indenture made and entered into the 15th day of February in the Year One Thousand eight hundred and forty three between Hiram Shiflett of the first part of the County of Greeene State of Virginia, and William Sims Jr. the County and State aforesaid of the same part. Witnesseth that for and in consideration of the sum of one dollar to him in hand paid by the said William Sims Jr. and before the ensealing and delivery of these presents, the note whereof is hereby acknowedged, hath given, grant, bargain and sold, and by these presents doth give, grant, bargain and sell unto the said William Sims Jr his executors or administrators, all his right, titles and interest in and to a certain tract or parcel of land lying and being in the County of Greene and state aforesaid and bounded by the lands of James Shiflett, of whom it was lately purchased, and also adjoining Elijah Morris, Louden Bruce, and Sukey[name is underlined, meaning it is misspelled] Morris, and containing by estimation between Seventy and eighty acres--also one horse, 8 head of hogs, 6 head of cattle, and all his household furniture of every description, with all and singular the appurtenances thereunto belonging, to the said tract of land and the said William Sims Jr. to have and hold the same. Upon trust never and help, that whereas the said Hiram Shifflett is justly indebted to James Shiflett in the sum of four hundred Dollars, as by bond bearing date the [left blank] day of December 1842, Now he the said Hiram Shiflett being desirous to secure, indemnify and make harmless the said James Shiflett his Execr. or admr. to the full amount of said bond with all interest, costs, damages etc. which may accrue. This Indenture witnesseth that it is distincly agreed and stipulated between the parties hereto subscribing their respective names that if the said Hiram Shiflett do not well and truly pay and discharge the above named bond, with interest cost, Damages, etc. on or before the 1st day of January one thousand and forty eight, that being the time agreed upon for payment of said land for the purchase of which the aforesaid bond was given, then and in that case the said William Sims Jr. his Excr. and adminr. shall have full power and authority, whenever the said James Shiflett shall request and desire it, shall advertise forteen days in the town of Stanardsville all the property conveyed in this trust, and proceed to sell the same for Cash to the highest bidder, and out of the proceeds of such sale, and after paying first all the necessary expenses of carrying this deed into effect, then shall pay over to the said James Shiflett, the just and full amount of his claim aforesaid, with Interest, costs, damages, etc. that may be then due to the said James Shiflett his Excr. or Admin. and should there be balance still remaining, after all the expenses of said trust are paid, the residue, the said William Sims Jr. shall pay over to the said Hiram Shiflett his heirs, Exr. This Indenture made and entered into this the 15th day of March one thousand, eight hundred & forty three, Between Trice Shiflett of the 1st part, William G Dunn of the 2nd part and MA Dunn & Co. of the third part and also Richard Dopey, Wm Catterton Sr and Parrott Elliott all of the County of Albemarle and State of Virginia. Viz: Witnesseth that the said Trice Shiflett for and in consideration of the sum of one dollar to him in hand paid by the said William G Dunn, the receipt whereof is hereby acknowledged, hath granted, bargained, and sold and by these presents doth grant bargain and sell unto the said William G. Dunn one tract of land adjoining James Gentry & Mery Sims etc. & Containing sixty or seventy five acres. Also three other tracts of land adjoining each other containing ninety acres the same on which the said Trice Shiflett now resides; two hundred horses, ten sheep, five head cattle, twenty three hogs, three feather beds & furniture, one Bureau , one Clock chairs tables one press, one Loom, pots, ovens, table ware, Kitchen furniture, Plantation tools corn oats & tobacco. To have and to hold the said property to him the said William G Dunn his heirs and assigns forever free from the Claim or Claims of all and every person or persons whatsoever. Upon trust nevertheless the following Conditions Whereas the said Trice Shiflett is justly indebted to M W Dunn the sum of four hundred dollars and by bond and accounts the 1st Day of January one thousand, eight hundred & forty three, also the said Trice Shiflett is justly due R Dopey Wm Catterton Sr. & P Elleott amounts which are due. Now the true meaning and intent of this Conveyance is such that should the said Trice Shiflett well & truly pay the above amounts due MA Dunn & Co. and also what is now due R Dopey Wm Catterton Sr & Parrot Elleott on before the 1st of January 1847 then this Indenture to be of no further use force or effect whatever but in case failure should occur either in whole or in part of what is hereby intended to be paid by the said Trice Shiflett, then the said Wm. G. Dunn upon request of MA Dunn & Co. their exors admors. is hereby authorized to advertise the above or within named property at some convenient public place in the neighborhood the time and place being named in the advertisement and f--ed by sd Trustee at his own discretion proceed to sell for the highest price that will be given in ready money, and after paying the above or within named debts with interest & Cost attending the same the balances if any to be paid to sd. Trice Shiflett or his legal representatives. Given under our hands and seals this day and year last above mentioned.

This Indenture made and entered into this fifteenth day of March, one thousand eight hundred and forty three, between John Shiflett and Vina Shiflett of the first part, and Ferral Shifflett of the second part all of the County of Greene and state of Virginia. Witnesseth: that for and in consideration of the sum of one hundred and fifty dollars to them in hand paid by the said Ferral Shiflett, a certain tract or parcel of land supposed to contain one hundred and Eleven acres be the same more or less and bounded as follows: Beginning on the Widow Douglas' line and running to Hucksteps road on the South side of the mountain, to John Morris line down the Yellow branch to Swift Run, down said Run to James Harris' line, with said Harris to Nancy Shifletts line and with said line to the beginning. To have and to hold the said tract of land and its appurtenances unto him the said Shiflett his heirs and assigns forever, free from the claim or claims of all and every person or persons whatever in witness wherof we have herunto set out hands and Seals the day and Year last above written.

This deed made and enacted this 23rd day of March in the year of our Lord one thousand eight hundred and forty three Between Absolum Shiflett of the first part now a resident of the County of Albemarle in the State of Virginia, James Michie Jr. of the same County and State of the second part and George Martin of the third part. Whereas the aforesaid Absolum Shiflett is indebted unto the said James Michie Jr. in the sum of two hundred and eighty three dollars and thirty three cents and to secure the payment of which he the said Absalom Shiflett is willing to execute these presents. Now this deed witnesseth that the said Absalom Shiflett for and in consideration of the premises and also of the sum of one dollar current money to him in hand paid and also the sum of two hundred & eighty three dollars and thirty three cents owing as above stated: He the said Absalom Shiflett hath given granted bargained sold and delivered up unto the said James Michie Jr. his heirs and assigns all and singular the following property, that is to say, 2 horser, 5 cows, 4 Yearlings, 4 feather beds, furniture and Counterpanes to screw?, 12 hogs, 2 Cupboards, 1 weaving loom, 1 table. Crop of tobacco and all other personal property, now in his possession: To have & to hold all and singular the before mentioned personal property, unto him the said James Michie Jr. his heirs and assigns forever. Provided nevertheless and it is hereby declared to be the true intent and meaning of these presents and the parties hereunto that the said property is mortgaged (in trust) by the said Absalum Shiflett to the said James Michie Jr. to secure the payment of the debt aforesaid. And furthermore the said Absalum Shiflett doth by these presents constitute and appoint the within named George Martin his true & lawful Attorney for him and in his stead to sell and dispose of the within mentioned at private or public sale as the case may require and the proceeds thereof to be applied first to the payment of the said sum of two hundred and eighty three dollars & thirty three cents, and the residue if any, to be applied first to the payment of the said sum paid over to the said Absolum Shiflett his heirs or assigns, Otherwise this deed and every matter and thing herein expressed or implied shall be of full force and virtue in law It being understood that if the within sum of $283 33/00 is paid on or before the 25 day of Decr 1844 then this deed is to be cancelled and of no effect

This Indenture made and entered into this 5th day of April 1843 between Stephen Shiflett of Albemarle County of the first part and Jno Dunn of the second part and Richard Dopey of the third part Witnesseth that whereas the said Stephen Shiflett is indebted to the said Richard Dopey to the amount of twenty six dollars by bond bearing date the day and date above mentioned and being desirous of indemnifying the said Richard Dopey from any loss by reason of the same in consideration of the premises, and in consideration of the sum of one dollar to him in hand paid by the sd. John Dunn hath granted, bargained and sold unto the said John Dunn One mare and colt 3 hed of cattle 12 hed of hogs 2 beds & furniture household and kitchen furniture to the said John Dunn forever, Use right and title to wich mare and colt, 3 hed of cattle 12 hed of hogs 2 beds and furniture, household and kitchen furniture, the said Stephen ---- warrants and defends unto the said Jno Dunn against the claims of himself and all other persons in trust nevertheless that if the said Stephen Shiflett shall well and truly pay off the above named debt together with all legal cost and interest from the above named debt that may accrue thereon, then this Indenture to be null and void but in default thereof it shall and may be lawful for the said John Dunn to en--- to Sale for ready money the above named mare and colt 3 head of cattle 12 head of hogs 2 bed & furniture household & kitchen furniture first giving reasonable notice of the time and place of such sale and out of the proceeds thereof, first pay to the said Richard Dopey the amount of the above named debt together with all legal interest and cost that may accrue thereon, and all cost carrying into execution this trust, and the overplus if any to be paid t the said Stephen Shifflet or his representatives. In witness whereof the parties have hereunto set their hands and seal the day and date above mentioned.

That the said Louden Shiflett and Lucinda his wife for and in consideration of the sum of one hundre d& twenty five dollars current money of Va. in hand paid by the said Candes Shiflett the receipt whereof is hereby acknowledged hath granted bargained & sold and confirmed and by these presents doth bargain sell and confirm unto the said Candes Shiflett her heirs etc. forever one certain lot or boundary of land containing by estimation fifty acres to be the same more or less Lying and being in Albemarle and Greene Counties on the waters Lynches river on County line Mountain and is bounded as follows To Wit Beginning with Henry B Shiflett on a chesnut oak in Richard Shifletts line thence a strait line to the lower end of the old May orchard to a pine and persimmon Tree thence with Trice Shifletts line to Nancey Simon's? line thence with her line to John Gentry's line with Gentry's line to Richard Shiflett line, thence with said Shiflett's lines --- to the Beginning To Have &to hold the aforesaid lot or boundary with all &singular the appurtenances unto the sd Candes Shiflett her heirs &assigns, free from the claim or claims of London Shiflett & Lucinda his wife or either of them or their heirs or assigns claiming under them or either of them or their heirs etc. proved, the said Loudon Shiflett and Lucinda his wife do by these presents do warrant and forever defend the right Title to sd. lot or boundary ---- and ------- free from the claim or claims of himself his wife Lucinda, their heirs, executors, administrators or assigns forever In witness whereof the sd Louden Shiflett and Lucinda his wife hath hereunto set their hands and affixed their seals the day & year above written.
